The Planning Commission met in regular session in the Council Chambers, City of Sunnyvale, 456 W. Olive Avenue, Sunnyvale, CA on January 24, 2005 at 8:00p.m. with Chair Moylan presiding.

1. 2004-0918 – SABA Inc. [Applicant] James S and Sallry K. Lindsey Et Al [Owner]: Application for a Use Permit on a 3-acre site to allow a new community center within a portion of an existing industrial building. ACTION: Comm. Babcock made a motion on Item #2004-0918 to adopt the Negative Declaration and deny the Use Permit. Vice Chair Hungerford seconded. Motion carried 6-0 with Comm. Fussell absent.
APPEAL OPTIONS: Item is appealable to the City Council no later than Tuesday, February 8, 2005.
2. 2004-0937 – Little Angels [Applicant] Cherry Blossom Properties, Inc. [Owner]: Application for a Use Permit to allow a Large Family Day Care at one unit in an apartment complex (Renaissance Apartments). The property is located at 718 Old San Francisco Road, Apartment 146 in an R-3/PD (Medium Density Residential) Zoning District. (APN: 211-04-002) AM
ACTION: Comm. Simons made a motion on Item 2004-0937 to approve the Use Permit with a modification to the conditions to state that the Use Permit shall be approved temporarily for one year and return to the Director of Community Development with a collection of traffic, noise, and impacts and to see if whether or not the impacts could be mitigated and the recreational facilities may not be used by the day care. Comm. Klein seconded. Motion carried 6-0 with Comm. Fussell absent.

3. 2004-0863 – Sprint PCS [Applicant] California Water Service Company [Owner]: Application for a Use Permit on a 33,541 square-foot site to allow a 50-foot tall monopole in a residential zoning district. The property is located at 800 Carlisle Way inan R-0 (Low Density Residential) Zoning District. (APN: 309-12-013) (Negative Declaration) AM
ACTION: Comm. Sulser made a motion on Item 2004-0863 to adopt the Negative Declaration and approve the Use Permit subject to the Conditions of Approval and to include that the tree pole be maintained and reviewed annually to make sure it remains in approximately the same shape it was put in and repaired if needed. Motion carried 5-1 with Comm. Simons dissenting and Comm. Fussell absent.

4. 2004-0952 – Susan Chen [Applicant]: Application for a Design Review on a 6,000 square-foot site to allow a 2,302 square-foot two story addition to an existing 1,208 square-foot single-story residence totaling 3,510 square feet and resulting in a 58% Floor Area Ratio (FAR) where 45% FAR may be considered without Planning Commission review. The property is located at 1067 Heatherstone Avenue in an R-0 (Low Density Residential) Zoning District. (APN: 198-24-005) RK
ACTION: Comm. Simons made a motion to approve the Design Review and delete Condition of Approval #3. Comm. Babcock seconded. Motion carried 6-0 with Comm. Fussell absent.

5. 2004-0955 – Larry K. Yamaoka [Applicant] Misako and George Yamaoka [Owners]: Application for related proposals on a 39,088 square-foot site located at 775 South Wolfe Road in an R-3/PD (Medium Density Residential/Planned Development) Zoning District. (Mitigated Negative Declaration) (APN: 211-05-008) JMc (Also to City Council on 02/15/05)
· General Plan Amendment from Medium to Low-Medium Density Residential;
· Rezone from R-3/PD (Medium Density Residential/Planned Development to R-2/PD (Low-Medium Density Residential/Planned Development) Zoning District;
· Special Development Permit to allow the construction of eight single-family homes, and
· Tentative Map to subdivide one lot into eight individual lots and one common lot.
ACTION: Comm. Babcock made a motion on Item 2004-0955 to adopt the Mitigated Negative Declaration and amend the General Plan from Medium to Low-Medium Density Residential, introduce an Ordinance to Rezone 775 South Wolfe Road from R-3/PD to R-2/PD, and approve the Special Development Permit and Tentative Map with modified conditions and approve alternative #2 of the proposed site plan and total street and sidewalk width can be reduced to 26 feet and Condition of Approval #11 on the addendum shall state a minimum of 2 trees and up to 4 trees with the approval and recommendation of the City Arborist. Comm. Simons seconded. Motion carried 4-2 with Chair Moylan, Comm. Sulser dissenting and Comm. Fussell absent.
APPEAL OPTIONS: Item will be considered by City Council on 2/15/05.

Discussion and Approval of 2005 Work Plan
Comm. Babcock made a motion to adopt the 2005 Work Plan as presented by staff. Comm. Simons seconded. Motion carried 6-0 with Comm. Fussell absent.

City Council Meeting Report
Ms. Ryan reported that at the January 11th City Council meeting an appeal of a telecommunication facility located at 1025 The Dalles was heard by council. She stated that the Planning Commission had approved the project but some of the neighbors who spoke at the hearing appealed the decision to the City Council. Ms. Ryan stated that the Council granted the appeal and denied the Use Permit and encouraged the church to look at reusing the existing tower rather than establishing a new tower on the site. She then stated that Council suggested a potential Study Issue for 2006 to further look at park properties for possible locations of telecommunication facilities. Ms. Ryan stated that there is no policy that would prohibit it but also there is no policy that encourages that kind of location. Ms. Ryan stated that another appeal for a telecommunication facility on Sunset Drive was scheduled to go to council this week but after hearing the outcome of The Dalles application the applicant withdrew their application. Ms. Ryan then updated the Commission on future appeals and stated that the Large Family Daycare application on Old San Francisco Road had been appealed to the City Council. She stated the application would go before council in February.
