The Planning Commission met in regular session in the Council Chambers, City of Sunnyvale, 456 W. Olive Avenue, Sunnyvale, CA on March 14, 2005 at 8:00 p.m. with Chair Moylan presiding.

PUBLIC HEARINGS/GENERAL BUSINESS
- 2005-0053 – Application for a Design Review on a 7,068 square-foot site to allow the conversion of attic space to 332 square feet of living area totaling 2,102 square feet and resulting in a 48.8% FAR (Floor Area Ratio) where 45% FAR may be allowed without Planning Commission review. The property is located at 1428 Hampton Drive in an R-0 (Low-Density Residential) Zoning District. (APN: 313-13-026) RK (Application withdrawn.)
ACTION: No action required as application was withdrawn.
APPEAL OPTIONS: No appeal option required as application was withdrawn.
- 2004-0912 – Ale Gicqueau [Appellant]: Appeal of a decision by the Director of Community Development denying a Design Review to allow a 200 square foot second floor deck off the rear left side of the residence. The property is located at 848 Pagoda Tree Court in an R-0 (Low Density Residential) Zoning District. (APN: 213-23-008) AM (Item continued from the February 28, 2005 Planning Commission meeting.)
ACTION: Comm. Babcock made a motion on Item 2004-0912 to approve Alternative 2 to approve the appeal for the design review permit subject to the conditions of approval with modification to Condition E. to state that the mature landscaping shall be maintained along the property lines on the subject property to ensure the deck remains screened from adjacent properties. Comm. Sulser seconded.
Motion carried unanimously, 7-0.
APPEAL OPTIONS: Item is not appealable, the decision is final.
- 2005-0059 – Application for a Design Review on a 6,926 square foot-site to allow a one-story addition to an existing two-story house totaling 3,377 square feet resulting in a 49% FAR (Floor Area Ratio) where 45% FAR may be allowed without Planning Commission review. The property is located at 1229 Rosseau Drive in an R-0 (Low-Density Residential) Zoning District. (APN: 211-30-039) KD
ACTION: Comm. Simons made a motion on Item 2005-0059 to approve staff recommendation, Alternative 1, approve the Design Review with attached conditions. Comm. Fussell seconded.
Motion carried unanimously, 7-0.
APPEAL OPTIONS: Item is appealable to the City Council no later than Tuesday, March 29, 2005.

City Council Meeting Report
Ms. Ryan reported that at the March 1, 2005 meeting, City Council considered modifications to the City Sign Code for both wall signs and ground signs. Council heard public testimony including concerns from auto dealers wanting taller signs than recommended by staff and the Planning Commission. Council approved height limits of 25 feet for ground signs and 7 feet on directional signs on El Camino Real. Another part of the report recommendation was to no longer allow large inflatable objects, which currently have only been allowed through the temporary sign and event regulations, but were not specifically allowed or disallowed through these regulations. The staff recommendation was to no longer allow them. Council made the modification to allow inflatable bounce house type objects on weekends as long as they are not taller than the adjacent building.
Ms. Ryan reported that at the March 8, 2005 meeting, Council considered possible amendments to the height limitations in the R-3 zoning district. Planning Commission had previously made recommendations to Council to make changes to the height to allow three stories up to 35 feet in height. Council made no changes to the R-3 height limit. Staff reported that Council was not opposed to heights greater than 30 feet, but wants to continue to have the case by case review to assure the appropriateness of exceeding the 30 feet. Council also directed staff to prepare a potential Study Issue for ranking in December 2005, regarding creating Townhouse-Only Zoning Districts that would allow three-story residential units. Comm. Simons asked staff if there was a recommendation of another potential zoning area related to when R-3 abuts up to single-family homes vs. when it does not. Ms. Ryan responded that there were some questions about when the R-3 is adjacent to other zoning districts. The code currently has a more restrictive height limit when development is adjacent to single-story, single-family residential development and no change was made to this. Council did not give any direction about where the Townhouse-Only Zoning District would be applied, only that it would be reviewed in December for possible study.
