SUNNYVALE SPECIAL planning commission

 

The Planning Commission met at a special session in the Council Chambers, City of Sunnyvale, 456 W. Olive Avenue, Sunnyvale, CA on September 20, 2004 at 8:00p.m. with Chair Moylan presiding.

PUBLIC HEARINGS/GENERAL BUSINESS

1.   2004-0584 – Amanda Estes [Appellant]:  Appeal of a decision by the Director of Community Development denying the removal of a large Redwood Tree.  The property is located is at 794 Steuben Drive in an R-1 (Low Density Residential) Zoning District. (APN: 202-17-029) SD 

ACTION:  Comm. Klein made a motion on Item #2004-0584 to continue to 10/11/04.  Comm. Fussell seconded.  Motion carried 6-0 with Comm. Simons absent.

 

APPEAL OPTIONS: Not appealable, item to be considered by Planning Commission on 10/11/04.

 

2.     2004-0566 – Richard Harmon [Appellant]:  Appeal of a decision by the Administrative Hearing Officer denying a Variance from Sunnyvale Municipal Code section 19.34.030 to allow a combined side-yard setback of nine feet and ten inches where twelve feet is required.  The property is located at 924 Mockingbird Lane in an R-0 (Low Density Residential) Zoning District.  (APN: 198-42-003) JMc

 

ACTION:  Vice Chair Hungerford made a motion on Item #2004-0566 to grant the appeal and approve the Variance.  Comm. Fussell seconded.  Motion carried 5-1 with Comm. Babcock dissenting and Comm. Simons absent.

 

APPEAL OPTIONS: Item may be appealed to the City Council no later than Tuesday, October 5, 2004.

 

3.    2004-0443Joseph Magliulo [Appellant]: Appeal of a decision by the Director of Community Development denying a Design Review to allow a new 2,795 square-foot two-story home resulting in a 45% Floor Area Ratio where 45% may be considered without Planning Commission review. The property is located at 1199 Fairwood Avenue in an R-0 (Low Density Residential) Zoning District. (APN: 104-26-046) RK

ACTION:  Comm. Babcock made a motion on Item #2004-0443 to deny the appeal and deny the Design Review.  Comm. Sulser seconded.  Motion carried with 6-0 with Comm. Simons absent.

 

APPEAL OPTIONS: Item is not appealable, Planning Commission decision is final.

 

4.     2004-0642 -Application for a Design Review on a 6,400 square-foot site to allow a new 3,070 square feet addition resulting in a 48% Floor Area Ratio where 45% may be considered without Planning Commission Review.  The property is located at 726 Carolina Avenue in an R-0 (Low Density Residential) Zoning District.  (APN: 204-08-004) RK

Comm. Klein made a motion on Item #2004-0642 to approve the Design Review subject to the Conditions of Approval.  Comm. Sulser seconded.  Motion carried 6-0 with Comm. Simons absent.

 

APPEAL OPTIONS: Item may be to the City Council no later than Tuesday, October 5, 2004.

 

5.     2004-0689 - City of Sunnyvale: Amendments to Sunnyvale Municipal Code Chapter 19.52  "Required Artwork in Private Developments" to Add Requirements for Greater Enforcement of Art in Private Development Requirements - This study considers possible legal and enforceable standards to ensure continued public visibility and access to art installed as a condition of development. DO

 

Comm. Sulser made a motion on Item #2004-0689 to recommend Alternatives #1, 2, 3, 4, 5, 6 and 7 to City Council to adopt the proposed amendments and to recommend that the City Council reconsider installation of indoor artwork for buildings that are open to the public.  Comm. Babcock seconded.  Motion carried 6-0 with Comm. Simons absent.

 

APPEAL OPTIONS: Not appealable, item will be considered by City Council on 10/12/04.

NON-AGENDA ITEMS AND COMMENTS

 

  • COMMISSIONERS ORAL COMMENTS

Comm. Babcock announced that there is now a 100 foot monopole at Yellowstone National Park located in front of the Old Faithful.

Chair Moylan reminded the Commission that this is the opportunity for the liaisons to share their visits with the Boards & Commission.

 

  • STAFF ORAL COMMENTS

City Council Meeting Report

 

Ms. Ryan reported that on 09/14/04, the City Council considered an appeal on the Planning Commission approving a monopole located at Birchwood Drive with a condition for a camouflage design.  The City Council granted the appeal and approved the existing monopole.

 

Ms. Ryan reminded the Commission that there is a potential study issue on Aesthetics Upgrade Requirements for monopoles.  She added that a planner who recently joined the City has worked with the telecommunications wireless industry.  He has provided staff with a number of examples of aesthetics choices and will be shared with the Commission.
