SUBJECT: Approval of Final Map – Legacy of Sunnyvale - Tract No. 9526

REPORT IN BRIEF

It is recommended that the City Council approve the final map for Tract No. 9526 (the Legacy of Sunnyvale), accept the public street dedication shown on the map, execute the subdivision agreement and accept the surety bonds for the subject subdivision project.

The final map for Tract No. 9526 is in conformance with the tentative map.  The subdividers have executed the subdivision agreement, provided surety bonds, paid development fees and furnished all other necessary documents to the City. 

BACKGROUND

Tract No. 9526 is a 34-unit single family detached project at the northwest corner of Mary Avenue and Iowa Avenue. The tentative map was approved by the Planning Commission at its March 10, 2003 and by the City Council at its March 25, 2003 meeting.

Zoning:                   R1.7/PD (Low Medium Density Residential/Planned Development)

Number of Lots:        35 lots

Area:                      3.96 acres (gross)

Owner/Developer:     Toll California General Partner Corporation, General Partner of Toll Land XIX Limited Partnership, managed by Toll Brothers, Inc

DISCUSSION

The final map for Tract No. 9526 has been examined by the Public Works Department staff and found to be in conformance with the Sunnyvale Municipal Code Title 18 Subdivision and the State of California “Subdivision Map Act” applicable at the time of approval of the tentative map.  The property owners have executed the subdivision agreement and posted surety bonds ($275,000.00 for faithful performance and $275,000.00 for labor and material) to guarantee completion of all public improvements. The development fees and other related documents have also been furnished to the City and found to be complete and in proper form. 

RECOMMENDATION

It is recommended that the City Council approve the final map, accept the public street dedication shown on the map, execute the subdivision agreement and accept the surety bonds for Tract No. 9526.
