RESOLUTION NO. _______

 

A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF SUNNYVALE DESIGNATING SPECIFIED PARCELS IN THE SUNNYVALE CENTRAL CORE REDEVELOPMENT PROJECT AREA AS A MASTER DEVELOPMENT AREA FOR REDEVELOPMENT BY ONE OR MORE MASTER DEVELOPERS

 

WHEREAS, pursuant to the California Community Redevelopment Law (Health and Safety Code Section 33000 et seq.), the City Council of the City of Sunnyvale has adopted, and the Redevelopment Agency of the City of Sunnyvale is responsible for implementing, the Sunnyvale Central Core Redevelopment Plan for the Sunnyvale Central Core Redevelopment Project (the "Plan") in the project area as described in the Plan (the "Project Area"); and

 

WHEREAS, the Agency has adopted its Rules For Business Tenant Preference and Owner Participation for the Project Area (the "Rules"); and

 

WHEREAS, a central purpose of the Plan is to revitalize the Project Area to create a more productive area that provides services and revenue to the residents of the City; and

 

WHEREAS, the staff report accompanying this Resolution demonstrates that it would be in the best interest of the redevelopment of the Project Area that all of the parcels located in the Town Center mall area consisting of all the land in the blocks bounded by Mathilda, Washington, Sunnyvale and Iowa with the exception of the existing bank building at the corner of Iowa and Mathilda be designated as a master development area for the purposes of obtaining unified development and potential assemblage of those parcels and interests therein; and

 

WHEREAS, Exhibit A, attached and incorporated by reference, is a map showing the parcels that comprise the master development area; and        

 

WHEREAS, the Agency desires to commence the process for selection of one or more master developers for all or substantial portions of the master development area, including solicitation of proposals from qualified property owners and other development entities for redevelopment of the master development area for retail, office and residential uses in accordance with the Sunnyvale Downtown Specific Plan;

 

WHEREAS, in accordance with the Rules, the owners of the parcels have been provided mailed notice of the Agency's consideration of this Resolution.

 

          NOW, THEREFORE, BE IT RESOLVED by the Redevelopment Agency of the City of Sunnyvale that:

 

1.   The Agency hereby determines the above Recitals are true and correct and serve, together with the accompanying staff report, as the basis for the actions set forth below.

 

2.    The Agency determines it is in the best interest of the redevelopment of the Project Area to redevelop all or substantial portions of the Master Development Area, consisting of the parcels shown in Exhibit A, as a unified development in accordance with the Plan and the Rules and hereby designates that area as a Master Development Area under the Plan and the Rules.

 

3.    The Agency Executive Director is authorized and directed to take the necessary steps, consistent with the Rules and this resolution, to solicit proposals from the owners of the Master Development Area and from those who have contracts for purchase of any portion of the parcels, and to present for Agency Board consideration recommendations concerning such selection.  The submitters shall be permitted to submit proposals that contemplate that one or more existing buildings remain and be integrated into the new development.

BE IT FURTHER RESOLVED that the selection of a proposal or proposals shall be governed by the following criteria:

                   ·  Consistency of the development proposal with the Downtown Specific Plan.

                   ·  The quality of the design of the development proposal.

                   ·  The amount of revenue that the proposed development will generate for the City and the Agency.

                   ·  The economic feasibility of the development proposal.

                   ·  The amount of Agency or City financial assisted requested.

                   ·  The financial capability of the developer to undertake and complete the proposed development.

                   ·  The experience of the developer and the development team in undertaking similar projects.

                   ·  The need for acquisition of property or property rights.

 

BE IT FURTHER RESOLVED that, pending completion of the master developer selection process, the Agency Executive Director is authorized to obtain appraisals, make conditional purchase offers, and seek to negotiate voluntary purchase agreements subject to final subsequent approval by the Agency Board, for any or all of the parcels comprising the Master Development Area; provided, however, that nothing in this Resolution constitutes a commitment or decision of the Agency to acquire any property.

 

          BE IT FURTHER RESOLVED that this Resolution shall become effective immediately upon its adoption.
