RESOLUTION NO. 104-03RA RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF SUNNYVALE AUTHORIZING A JOINT PUBLIC HEARING TO CONSIDER ADOPTION OF THE PROPOSED AMENDMENT TO THE REDEVELOPMENT PLAN FOR THE CENTRAL CORE REDEVELOPMENT PROJECT AREA

 

RESOLUTION NO. 105-03RA  A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF SUNNYVALE AUTHORIZING PROCEEDING WITH AN AMENDMENT TO THE REDEVELOPMENT PLAN FOR THE CENTRAL CORE REDEVELOPMENT PROJECT TO CONFORM LAND USES AND REINSTITUTE EMINENT DOMAIN AUTHORITY OVER NONRESIDENTIAL PROPERTY FOR TWELVE YEARS AND TAKING RELATED ACTIONS

Update of Redevelopment Agency's Owner Participation Rules

Robert Paternoster, Agency Secretary/Director, presented the staff report.  He stated the Community Redevelopment Law requires the Agency to have rules for owner participation and preferences for businesses dislocated as a result of the Agency's redevelopment activities to re-enter business in the redevelopment project area. The general rules in the Redevelopment Plan are somewhat outdated. Staff proposes to update the Agency’s owner participation rules so that they will operate effectively.

 

Vice Chair Risch inquired if the Agency has met all the noticing timelines according to law.  Agency Counsel Armento stated they have and there is not a ten day notice for owner participation rules.

 

Agency Member Walker questioned owner participation rights. Agency Secretary/Director Paternoster responded that if a property was not in conformance with the plan, the Agency could require the owner to bring the property into conformance.  If the owner did not do that, one remedy would be to acquire that property, but the Agency does not have to act at all.  Agency Counsel Armento clarified that the owner can come forward with proposals for development of the property and this can be handled on an individual basis.

 

Agency Chair Miller opened the Public Hearing at 1:32 a.m. and, there being no public comments, closed the Public Hearing.

 

Vice Agency Chair Risch moved, and Agency Member Walker seconded, to adopt the attached resolution updating Rules for Business Tenant Preference and Owner Participation.  The motion carried unanimously.
