A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SUNNYVALE ACCEPTING AS COMPLETED WORK THE CONWAY ROAD IMPROVEMENTS PROJECT (ST-98/03-99), AUTHORIZING FINAL PAYMENT AND DIRECTING CITY CLERK TO FILE NOTICE OF COMPLETION

 

          WHEREAS, the Director of Public Works of the City of Sunnyvale has, in writing, made and filed in the Office of the City Clerk his notice or certificate certifying that the work under contract described as Conway Road Improvements Project (ST-98/03-99) has been completed in conformance with the plans and specifications for the project and has recommended that the work be accepted;

 

          NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SUNNYVALE THAT:

 

          1.  The work by and with Top Grade Construction, as contractor, as mentioned in the notice or certificate of the Director of Public Works, is hereby accepted as complete and the Director of Finance is authorized to make final payment, exclusive of retention.

 

          2.  The City Clerk is hereby authorized and directed to file with the County Recorder of the County of Santa Clara notice of the completion of the project within ten (10) days from the date of this resolution.

 

          Adopted by the City Council at a regular meeting held on November 11, 2003, by the following vote:
