SUMMARY

A regular meeting of the Sunnyvale Planning Commission was held on October 27, 2003, at 8:00 p.m. in the Council Chambers, City Hall, 456 West Olive Avenue, Sunnyvale, with Chair Simons presiding.
Members Present: Chair Babcock, Vice Chair Moylan, Comms. Chu, Hungford, Lee, Simons, and Swegles

Comm. Simons made a motion to approve the minutes of October 13, 2003 with modification. Comm. Swegles seconded. |
Report on Council Meeting
Trudi Ryan, Planning Officer, reported that on October 14, 2003, City Council approved the revised Downtown Specific Plan.
Ms. Ryan further reported that on October 21, 2003, the City Council and Planning Commission held a joint study session on the Moffett Park Specific Plan and Transportation Strategic Program.
During the public hearing section, the City Council considered the Recreational Vehicles, Boats and Trailers Study Issue. Ms. Ryan reported that City Council generally adopted the Planning Commission recommendations and approved the effective date as January 1, 2005. They directed staff to evaluate city owned properties that might be used as storage.
She also reported that the City Council considered the Community Outreach Task Force Study and directed staff to form an Outreach Task Force for a trial period of one year and extend the noticing for second story additions.

Citizens To Be Heard
Harriette Rowe, a member of the Sunset Oaks HOA, expressed her concerns with the Planning Commission's recent action on a development project which demonstrated a lack of compassion to residents' concerns. She noted that the Commission should have continued the item and should have listened and allowed the public to have alternatives or opportunity to review the revised application. The Commission failed to acquiesce. She acknowledged the information received from Vice Chair Moylan that the Commission is mandated to consider applications based on land use. However, she urged the Commission to listen to public interests, concerns and input for future project consideration.

1. 2003-0536 - Classic Communities [Applicant] Koreski Family Trust [Owner] - Application for related proposals on a 40, 209 square foot site located at 637 East Arques Avenue in an MS/ITR/R-3 (Industrial & Service/Industrial to Residential/Medium Density Residential) Zoning District. (APNs: 205-30-008 and 205-30-009) (Negative Declaration) SL (Staff recommends an indefinite continuance)
· Special Development Permit to allow construction of 54 townhomes and
· Tentative Map to subdivide two lots into 54 lots and one common lot.

Vice Chair Moylan made a motion on Item #2003-0536 to continue the project indefinitely. Comm. Swegles seconded. Motion carried 7-0. |
APPEAL OPTIONS: No appeal options at this time due to indefinite continuance.
2. 2003-0634 - City Council [Appellant] San Jose Sabercats [Applicant]: Appeal of a decision by the Administrative Hearing Officer denying a Use Permit on a 71-acre site to allow a tent over the Sabercats practice field from November through July annually. The property is located at 1095 Dunford Avenue in a PF (Public Facility) Zoning District. (APN: 313-10-004) EW Pre-appealed by City Council.

Comm. Lee made a motion on Item #2003-0634 to deny the appeal and uphold the decision of the Administrative Hearing Officer denying the Use Permit to allow a tent over the Sabercats practice field from November through July annually. Comm. Chu seconded. Motion carried 5-2 with Vice Chair Moylan and Comm. Simons dissenting. |
APPEAL OPTIONS: Applicant appealed action on October 28 to City Council.
3. 2003-0414 - Appeal of a decision by the Administrative Hearing Officer denying a Variance from SMC (Sunnyvale Municipal Code) section 19.48.020 to allow a 3.5' and 6.5' fence in the corner and driveway vision triangles. The property is located at 811 Homestead Road in an R-1 (Low-Density Residential) Zoning District. (APN: 323-21-034) CC

4. 2003-0600 - Dale Meyer [Applicant] Fukui Construction [Owner] - Application for related proposals on a 13,650 square foot site located at 391 S. Bernardo Avenue in an R-3 (Medium Density Residential) Zoning District. (Negative Declaration) (APN: 161-20-026) SL (Also to City Council on 11/11/03)
· Rezone from R-3 (Medium Density Residential) to R-3/PD (Medium Density Residential/Planned Development) Zoning District;
· Special Development Permit to allow construction of six attached townhomes, and
· Tentative Map to subdivide one lot into six lots and one common lot.

Comm. Swegles made a motion on Item #2003-0600 to recommend to City Council adoption of the Negative Declaration and approval of the Rezone from R-3 to R-3/PD, the Special Development Permit and Tentative Map with modification that Condition of Approval #21 shall include large species where appropriate. Comm. Simons seconded. Motion carried 5-2 with Vice Chair Moylan and Comm. Lee dissenting. |
APPEAL OPTIONS: No appeal, item to be considered by City Council.
5. 2000-0523 - City of Sunnyvale Study Issue - Certification of the Moffett Park Specific Plan Environmental Impact Report and adoption of the Moffett Park Specific Plan. KDI (Also to City Council on 11/11/03)

Comm. Chu made a motion on Item #2000-0523 to recommend to City Council Certification of the Final EIR and adoption of the Statement of Overriding Considerations. Comm. Swegles seconded. Motion carried 7-0. |

Comm. Chu made a motion on Item #2000-0523 to recommend to City Council B-1 - adoption of the General Plan Amendments for the creation for the geographic creation of the Moffett Park Specific Plan. Comm. Swegles seconded. Motion carried 7-0. |

Comm. Simons made a substitute motion on Item #2000-0523 to recommend B-4 to direct staff to prepare an implementing ordinance based on Planning Commission review of development applications with the following criteria: 1) Planning Commission Public Hearing for all development up to the Standard FAR (Floor Area Ratio) and maximum FAR levels with exception that development up to standard FAR requesting expedited Staff Review with Planning Commission Study only, requires MP-I LEED Certified Buildings and MP-TOD LEED Silver Buildings and 2) All development requesting access to the development reserve to exceed the Standard FAR limit requires MP-I LEED Certified buildings and MP-TOD LEED Silver buildings. Vice Chair Moylan seconded. Motion carried 5-2 with Comms. Chu and Swegles dissenting. |

6. Ranking of Potential Study Issues
The Planning Commission ranked the following Study Issues to be recommended to City Council.
1. CDD-1 - Transportation Demand Management (TDM) Program for Higher Density Residential Projects
2. CDD-2 - Clarify CEQA requirements and Heritage Preservation Commission's Role in Relation to the Heritage Preservation Code.
3. CDD-18 - Height Limit in R-3 Zoning District.
4. CDD-19 - Provision of Adequate Guest Parking in Small Multi-Family Residential Projects.
5. CDD-28 - Modification to the BMR in lieu-fee requirements
6. CDD-21 - Places of Assembly located within Industrial and Commercial Zones
7. CDD-11 - Update of the Socio-Economic Element
8. CDD-27 - Update the Tree Removal Ordinance
7. Proposed Announcements to City Council meeting
There were no proposed announcements to the City Council meeting.
Oral Communications
Comm. Lee announced that Election day is on Tuesday, November 4 and reminded the public to vote.
Comm. Chu added that included in the ballot is election for Sunnyvale School District and Measure D. He urged the public to vote.
