October 7, 2003

 

The City Council of the City of Sunnyvale adjourned from a 5:00 p.m. Study Session regarding Revisions to the Taxicab Ordinance, to a 6:00 p.m. Study Session regarding Proposed Program Restructures for Programs Managed by the Public Safety Department, and met in regular session in the City Council Chambers, 456 West Olive Avenue, Sunnyvale, CA at 7:32 p.m. with Mayor Miller presiding.

Mayor Miller, joined by Dane Beezley, Chair of the Arts Commission, Diane Moglen, Arts Recreation Supervisor, and Nancy Steward, Superintendent of Arts and Recreation, proclaimed October as National Arts and Humanities Month in Sunnyvale.

 

Mayor Miller presented Earl Miguel, of Fremont High School, a Certificate of Appreciation for his contributions on the graphic design for the Fun on the Run truck.

 

Mayor Miller, joined by Chief Ernie Bakin and Captain Tim Carlyle, congratulated the Sunnyvale SWAT Team who finished in first place at the annual SWAT competition, and noted they have won five of the last nine competitions they have competed in. Captain Carlyle introduced the following SWAT members: Lt. Douglas Sims, Lt. Richard Sautter, Lt. Kevin Nelson, Team Leader William Honsal, Team Leader Vinicio Mata, Assistant Team Leader Timothy Sartwell, Assistant Team Leader Scott McDowell, Assistant Team Leader Joel Witmer, Officer Rafael Chavez, Officer Donald Discher, Officer Daniel Moskowitz, Officer David LaFaver, Officer Regan Williams Jr., Officer Emmett Larkin, and Officer Gregory Othon.

 

PUBLIC ANNOUNCEMENTS

 

Councilmember Valerio made the following announcements on behalf of the Council:

 

Congratulations are in order for the Sunnyvale Tennis Club and it’s women’s team, who recently captured the United States Tennis Association’s National Championship in Tucson, Arizona, for play at the 3.0 level by beating several other teams from across the country.

 

On Wednesday, October 8, students and parents from West Valley Elementary, Cherry Chase Elementary, Cumberland Elementary, Braly Elementary, Ponderosa Elementary, and Sunnyvale Middle School will join hundreds of Mayors, City Councilmembers, Superintendents, and other community leaders from across the country for a walk to school in celebration of International Walk to School Day. The Partnership for a Walkable America established Walk to School Day to encourage parents to walk to school with their children in an effort to promote physical activity, pedestrian safety, and to become aware of the difficulties children face on their trip to school each day. Please join in the world-wide walking celebration and plan to walk your child to school tomorrow, October 8. A bilingual health program titled “Disruptive Behavior or ADHD” will be held at Columbia Middle School on Wednesday, October 8, from 7:00 p.m. to 8:00 p.m.  A panel of local health professionals will educate parents about the signs of attention-deficit and hyperactivity disorder (ADHD), how to help their children succeed at school and at home, and where to find help in the community.  The program will take place in the Multipurpose Room at Columbia Middle School, located at 739 Morse Avenue.  The program will be presented in both English and Spanish, and is offered free to the public.

The Columbia Neighborhood Center will be holding its 5th Annual Family Fun Night at the Gym on Wednesday, October 15, from 6:30 p.m. to 8:30 p.m.  Families are invited to come and enjoy an evening of arts and crafts, games, and contests together.  The event will take place at the gymnasium inside Columbia Neighborhood Center, located at 785 Morse Avenue.  For more information, contact the Columbia Neighborhood Center at (408) 523-8150.

 

Mayor Miller thanked the Public Information Office for a job well done on the Sunnyvale Quarterly Report.

 

Councilmember Vorreiter congratulated Nancy Smith, Vice Chair of the Sunnyvale Housing and Human Services Commission, on her appointment to the Santa Clara County Housing and Community Development Commission, and thanked Yolanda Risch for serving the City of Sunnyvale in this capacity for several years.

Councilmember Fowler requested item 1.A. be pulled due to his absence at the September 30 Council meeting.  Mayor Miller moved, and Councilmember Howe seconded, to approve the Consent Calendar with the exception of 1.A.  The motion carried unanimously.

Councilmember Howe moved, and Councilmember Vorreiter seconded, approval of the Draft Minutes.  The motion carried with Councilmember Fowler abstaining.

Staff Recommendation: Approve the Final Map and authorize the execution of the Subdivision Agreement for the subject subdivision.

 

CITIZENS TO BE HEARD

 

Steve Fisk, representing the Sunnyvale Public Safety Officers Association (PSOA), distributed a letter of complaint to the Council in response to a letter from Vice Mayor Risch regarding the events of August 31, 2003.  He requested the Council initiate an investigation of the actions of the Vice Mayor on the influence placed on Public Safety on behalf of a single business establishment, and the role the City Manager played as a conduit for the interference.

 

City Manager LaSala and Chief Ernie Bakin responded to questions from the Council regarding procedures and the events of August 31.

 

In response to Councilmember Vorreiter’s concerns regarding three Councilmember’s support of candidate Melinda Hamilton, Councilmember Howe stated he is not endorsing either candidate for seat 7.

 

Councilmember Fowler stated, for the record, that he is supporting candidate Melinda Hamilton for seat 7 of the City Council, and offered to abstain from participation in the subcommittee.

 

Mayor Miller requested a subcommittee be formed to include Councilmembers Fowler, Valerio and Howe. 

 

Councilmember Howe requested that Councilmember Walker be asked to serve on the subcommittee and, if Councilmember Walker is not able to serve, he will agree to serve.

 

Michael Flores, candidate for Council, reminded the public that there are a number of candidate forums coming up with the next one tomorrow evening at Lakewood.  If the public would like additional information, they can contact him at floresforsunnyvale@yahoo.com.

It was the consensus of the Council to continue this item to October 14, 2003.

2003-0613 Forum Development Group, LLC/Lehman Brothers [Applicant] (Request for Continuance to October 14, 2003)

 

Robert Paternoster, Director of Community Development, reported the Forum Development Group requested this item be withdrawn until further notice.

 

It was the consensus of Council to continue this item indefinitely.

Appeal of Planning Commission Agenda of September 22, 2003 and Administrative Hearing Agenda of September 24, 2003

 

No action was taken.

 

NON-AGENDA ITEMS & COMMENTS

 

COUNCIL

 

Councilmember Howe stated he would like to sponsor a study issue for changing the date of the municipal election to even years in consideration of potential budget savings.

 

Mayor Miller stated the Council needs to look at process and policy issues for Study Sessions and Closed Sessions regarding record keeping.  Mayor Miller and Councilmember Howe will co-sponsor a study issue on this matter.
