SUBJECT: CONTINUATION OF BUREAU OF JUSTICE ASSISTANCE BLOCK GRANT AND BUDGET MODIFICATION No. 9
REPORT IN BRIEF
The Bureau of Justice Assistance (BJA) is making available a grant of $25,997 for FY 2003/2004 to Sunnyvale through Local Law Enforcement Block Grant (LLEBG) to reduce crime and improve public safety.  The City provides Sunnyvale’s required matching funds, approximately $2,889, from the General Fund.  Staff recommends Council approve appropriation of the full amount available from the BJA-LLEBG to the LLEBG Sub-Fund of the Police Services Augmentation Fund. The grant and matching funds were included in the adopted budget for FY 2003/2004, but at higher amounts. Because the grant and the required matching funds are lower than anticipated, a budget modification is necessary.
BACKGROUND
Since FY 1996/1997 Sunnyvale has received supplemental law enforcement funding from the federal and state governments to reduce crime and improve public safety.  This funding has provided for the employment of a Patrol Team Captain and partial funding for two Internal Affairs Investigations Lieutenants, as previously approved by Council.

DISCUSSION

Acceptance and appropriation of the FY 2003/2004 LLEBG award will allow the continued provision of partial salary and overtime support for the Internal Affairs Lieutenants.    In addition to the BJA grant award, further funding is provided to the City by the State in accordance with the Community Oriented Police Services (COPS – SLES) program.  As funding from the COPS – SLES program constitutes the majority of the funding within the Police Services Augmentation Fund staff will report to Council any potential revisions to appropriations upon receipt of this funding.

 

Local Law Enforcement Block Grant Program Advisory Board

 

As required by law, the LLEBG Advisory Board met on October 1, 2003 to discuss and make recommendations for programs to receive the federal grant distribution of $25,997 for FY 2003/2004.  The Board consisted of: Judge Rise Jones Pichon, Santa Clara County Municipal Court; Bill Hyland, Fremont Union High School District; Amy Choate, Safe Place Program; Jay Boyarsky, Santa Clara County District Attorneys Office; and Captain Greg Kevin.

 

The Advisory Board unanimously approved use of grant funding for the Internal Affairs Lieutenants.
FISCAL IMPACT

The LLEBG amount of $33,685 was included in the FY 2003/2004 approved budget, along with a General Fund match of $3,743. Budget Modification No. 9 accepts the lower grant amount of $25,997 and reduces the General Fund match to $2,889.

Public contact was made through posting of the Council agenda on the city's official notice bulletin board, posting of the agenda and report on the city's web page, publication of the Council agenda in the San Jose Mercury News, and the availability of the report in the Library and the City Clerk's Office.
ALTERNATIVES

1. Appropriate the full amount available from the Local Law Enforcement Block Grant (LLEBG) into the City’s LLEBG Sub-Fund of the Police Services Augmentation Fund and approve Budget Modification No. 9.

2. Do not appropriate the funding.

3. Direct staff to conduct further study.
RECOMMENDATION
Staff recommends Alternative 1, appropriation of the full amount available from the Local Law Enforcement Block Grant (LLEBG) into the LLEBG Sub-Fund of the Police Services Augmentation Fund and approval of Budget Modification No. 9.
