SUBJECT: Approval of Final Map – Danbury Place - Tract No. 9506
REPORT IN BRIEF

The final map for Danbury Place is in conformance with the tentative map. The subdividers have executed the subdivision agreement, provided surety bonds, paid development fees and furnished all other necessary documents to the City. It is recommended that the City Council approve the final map, accept the public street dedication shown on the map, certify the vacation of a portion of the public utility easement, execute the subdivision agreement and accept the surety bonds for the subject subdivision project.

BACKGROUND

Tract No. 9506 is a 168-unit condominium project at the southwest corner of Fair Oaks Ave. and Tasman Dr. The Planning Commission at its April 14, 2003 meeting approved the tentative map.

Location: 1120 Karlstad Dr., 1131 and 1141 N. Fair Oaks Ave.

Zoning: M-S/ITR/R3/PD

Number of Lots: 56 lots

Area: 8.80 acres

DISCUSSION

The final map for Danbury Place has been examined by the Public Works Department staff and found to be in conformance with Sunnyvale Municipal Code Title 18 Subdivision and the State of California "Subdivision Map Act" applicable at the time of approval of the tentative map. The property owners have executed the subdivision agreement and posted surety bonds ($768,500.00 for faithful performance and $768,500.00 for labor and material) to guarantee completion of all public improvements. The development fees and other related documents have also been furnished to the City and found to be complete and in proper form.

As part of the conditions of approval of the subject subdivision, public street dedication is required for a right-turn lane on Tasman Dr. into Fair Oaks Ave. The lane is required of the General Plan Amendment to establish/update the Industrial to Residential (ITR) area in July of 2002.

Vacation of a portion of the existing public utility easement is necessary for the project due to the approved site plan. Pursuant to Subdivision Map Act Section 66499.20½, the filing of the final map constitute such partial abandonment of a public easement.
