Jane Vaughn, with Menlo Equities and representing Forum Development, stated that Forum was not able to attend the meeting tonight because they are in New York to close their deal with Lehman.

Christen Powell, representing Lehman, stated that they are committed to work with Forum and are committed to this project.

Jane Vaughn, with Menlo Equities and representing Forum Development, stated they are looking at ways to increase the retail space, and if they are successful in acquiring the Chevy’s property, the work will be done in one phase.

Agency Member Miller moved, and Vice Chair Chu seconded, to accept staff’s recommendation for Alternative 1, as amended, to designate Fourth Quarter Properties XLVIII, LLC, as the Master Developer for the Town Center Mall redevelopment and grant a 90-day exclusive right to negotiate upon receipt of a $80,000 non-refundable deposit.
