CONSENT CALENDAR
Vice Chair Chu moved, and Agency Member Lee seconded, with a friendly amendment, to approve the Consent Calendar. The motion carried unanimously.

Selection of Master Developer for Redevelopment of Town Center |
Robert Paternoster, Agency Secretary/Director, assisted by Mary Bradley, Agency Treasurer, presented the staff report.
Staff responded to Agency Member questions including the developer’s financials statements, photographs and names of elected officials that were consulted, and the agreement on the tax increment.
Agency Member Miller said she would like to see the photographs of the other projects by the developer and the names of elected officials referenced by staff.
Agency Chair Howe opened the Public Hearing at 10:19 p.m.
Jane Vaughn, with Menlo Equities and representing Forum Development, stated that Forum was not able to attend the meeting tonight because they are in New York to close their deal with Lehman.
Arthur Schwartz, a member of the public, stated he wanted to see the project completed quickly without a second phase for office space.
Christen Powell, representing Lehman, stated that they are committed to work with Forum and are committed to this project.
Jane Vaughn, with Menlo Equities and representing Forum Development, stated they are looking at ways to increase the retail space, and if they are successful in acquiring the Chevy’s property, the work will be done in one phase.
Agency Chair Howe closed the Public Hearing at 10:33 p.m.
Agency Member Miller moved, and Vice Chair Chu seconded, to accept staff’s recommendation for Alternative 1, as amended, to designate Fourth Quarter Properties XLVIII, LLC, as the Master Developer for the Town Center Mall redevelopment and grant a 90-day exclusive right to negotiate upon receipt of a $80,000 non-refundable deposit. The motion carried unanimously.
