SUBJECT: City Council Appointments to Valley Transportation Authority (VTA) Board of Directors and VTA Policy Advisory Committee
REPORT IN BRIEF
On August 19, 2004, Councilmember Fred Fowler submitted his resignation as the Sunnyvale representative on the VTA Board of Directors (see Attachment B.) In his resignation letter, Councilmember Fowler nominated Vice Mayor Dean Chu as his replacement on the VTA Board. Staff recommends that Council appoint one of its members to serve as VTA Board representative. Vice Mayor Chu is currently the Sunnyvale representative on the VTA Policy Advisory Committee (PAC). Should Council accept Councilmember Fowler’s nomination of Vice Mayor Chu as the VTA Board representative, Vice Mayor Chu will need to resign from the VTA PAC representative position. Should Council appoint Vice Mayor Chu as the new VTA PAC representative, staff recommends Council take action at this meeting to appoint another member to the VTA PAC.
BACKGROUND
Traditionally, in January of each year, the City Council fills a number of positions for intergovernmental (IGR) assignments (see Attachment A.) The City Council appoints members to a variety of IGR agencies in order to represent the City's interests and to influence policies and regulations of other agencies. The City Council also ratifies the appointments of Councilmembers made by other organizations. From time to time, appointments come up that require Council action outside of the normal timeframe.
EXISTING POLICY
Goal 7.3C Participate in intergovernmental activities, including national, state and regional groups, in order to represent the City's interest, influence policy and regulations, and enhance awareness.
Policy 7.3C.1 Represent adopted City policy in intergovernmental activities.

FISCAL IMPACT
There is no fiscal impact to this report.

Public contact was made through posting of the Council agenda on the City's official notice bulletin board, posting of the agenda and report on the City's web page, publication of the Council agenda in the San Jose Mercury News, and the availability of the report in the Library and the City Clerk's Office.
ALTERNATIVES
1. Appoint a Councilmember to serve as the new VTA Board of Directors representative.
2. If a vacancy exists because of tonight’s Council action, appoint a Councilmember to serve as the new VTA Policy Advisory Committee representative.
3. Appoint a Councilmember to serve as representative to one VTA committee but not the other.
4. Do not appoint a Councilmember to serve as representative to either VTA committee.
5. Take no action at this time.
6. Other action as directed by Council.
RECOMMENDATION
Staff recommends Alternatives 1 and 2: Appoint a Councilmember to serve as the new VTA Board of Directors representative and, if a vacancy exists because of tonight’s Council action, appoint a Councilmember to serve as the new VTA Policy Advisory Committee representative.
