SUBJECT: Reallocation and Appropriation of Remaining Available Measure B Pavement Management Program Funds and Budget Modification No. 23

REPORT IN BRIEF

Staff recommends City Council reallocate and appropriate Measure B Pavement Management Program (PMP) funds for existing and new projects as described in this report.  

BACKGROUND

Measure B PMP is funded by the County of Santa Clara's Measure B Transportation Improvement Program, which is a November 1996 voter-approved ½ cent general sales tax dollar increment that will extend through April 2006.  Measure B PMP funds are administered by the Valley Transportation Authority (VTA), and are restricted to pavement maintenance use only.  Measure B projects must be completed on or before July 31, 2004.  Funds not expended by the deadline date will be rescinded by VTA.

 

DISCUSSION

 

There are approximately $953,000 of unallocated Measure B PMP funds that need to be expended by July 31, 2004.  This is a result of various savings from projects that were completed under budget and interest earnings from the Measure B PMP funds drawn from VTA. 

Staff recommends Council reallocate and appropriate these funds to various projects that can be categorized in three groups:

  • Group A includes four existing Measure B projects currently under construction, which require reallocation of funds.  The original budget for one of the four projects, Mathilda Avenue from Maude to San Aleso (Project #823970) provided funds only for design.  The increase of $231,000 is to cover the cost of construction.  The scope of two other projects, Maude Avenue from Pastoria to Mathilda (Project #823990) and Sunnyvale/Saratoga Road from Fremont to Talisman (Project #824000) was revised due to detailed condition assessment during design which indicated the need for additional preparatory work prior to overlaying.  The current funding for the fourth project, Battery Back-up System Phase 1 was short by $15,000 and the increase was approved by VTA.  This allowed the City to utilize Measure B funds rather than Gas Tax funds.
  • Group B includes the design and construction costs of five new projects that staff recommends for funding.  These streets are rated as high priority for street maintenance by staff due to the poor existing surface conditions.
  • Group C includes the design costs for six additional new projects not included in Group B.  While there are not enough funds to construct these projects, completing the design work will allow these projects to be ready for construction should funding from unspent Measure B PMP monies become available.

FISCAL IMPACT

There are approximately $953,000 of unallocated Measure B PMP funds that need to be expended by July 31, 2004.  Staff recommends City Council reallocate and appropriate $904,335 in Measure B PMP funds to the projects outlined below in Groups A, B and C. The remaining $48,665 Measure B funds will be set aside as contingency for Measure B related projects.

ALTERNATIVES

1. Reallocate and appropriate Measure B Pavement Management Program funds for street improvement projects as outlined in this report and approve Budget Modification No. 23.

2. Do not reallocate and appropriate Measure B Pavement Management Program funds for street improvement projects and do not approve Budget Modification No. 23.  Unspent Measure B PMP funds must be returned to the VTA.

RECOMMENDATION

Staff recommends Alternative No. 1.
