SUBJECT: Award of Contract for Engineering Design and Construction Support Services for the 2003/2004 Measure B Street Pavement Maintenance of Effort Project (#F0312-36)

REPORT IN BRIEF

Approval is requested for the award of a contract to Nichols Consulting Engineers, CHTD, of Santa Cruz for engineering design and construction support services for the 2003/2004 Measure B Street Pavement Maintenance of Effort (MOE) Project for the Department of Public Works Engineering Division; Project Administration (Project #ST-03/03-04).

BACKGROUND

Measure B Pavement Management Program (PMP) is funded by the County of Santa Clara's Measure B Transportation Improvement Program, which is a November 1996 voter-approved 1/2 cent general sales tax dollars increment that will extend through April 2006.  Measure B PMP funds are administered by the Valley Transportation Authority (VTA), and are restricted to pavement maintenance use only.  Measure B projects must be completed on or before July 31, 2004.  Funds not expanded by the deadline date will be rescinded by VTA.

Budget Modification No. 23 (RTC #04-049), also on the February 24, 2004, Council Meeting Agenda, reallocates and appropriates remaining Measure B PMP funds for three groups of projects.  The requested contract with Nichols Consulting Engineers includes the design of the six projects included in Group C plus three additional projects which are already funded in the Street Maintenance Division's operating budget.

DISCUSSION

Staff recommends retaining the services of Nichols Consulting Engineers CHTD, to complete the design for the new projects.  Contracting with Nichols will save time by leveraging their experience gained from the design of the most recent Measure B street projects.

Section 2.08.070(b) of the Sunnyvale Municipal Code exempts from bidding contracts for professional services.

FISCAL IMPACT

Project costs are as follows:

Design and Construction Support   $89,355
Contingency (optional services at the discretion of the Director of Public Works) NTE $9,000
Total NTE $98,355

Funds for locations (a) to (j) as described in Exhibit A, section 1.1 of the draft Agreement are available pending Council approval of Budget Modification No. 23 (RTC 04-049) which reallocates and appropriates Measure B PMP funds.  Funds for pavement maintenance at Cypress Avenue from Fair Oaks to Worley, Kifer Avenue from Wolfe to Fair Oaks, and Santa Coleta Court from Ferndale to the south end are available in the Street Maintenance Division operating budget.

RECOMMENDATION

It is recommended that Council award a contract, in substantially the same form as the attached draft and in an amount not to exceed $98,355, to Nichols Consulting Engineers, CHTD, to provide engineering design and construction support services for the 2003/2004 Measure B Street Pavement Maintenance of Effort Project.
