A regular meeting of the Sunnyvale Planning Commission was held on January 26, 2004, at 8:00 p.m. in the Council Chambers, City Hall, 456 West Olive Avenue, Sunnyvale, with Chair Babcock presiding.

Approval of the Minutes of January 12, 2004

 

Comm. Klein made a motion to approve the minutes of January 12, 2004 with minor modifications.  Vice Chair Comm. Moylan seconded.

 

Motion carried 7-0.

Public Hearing

 

1. 2003-0913 - Dan Winklebleck [Applicant] - Application for a Design Review on a 6,000 square-foot site to allow both first and second story additions resulting in a 3,373 square foot home at a 56.2% FAR where 45% is allowed without a Planning Commission Review.  The property is located at 1078 Heatherstone Drive in an R-0 (Low-Density Residential) Zoning District. (APN: 198-23-087) KDI (Applicant requests continuance to February 9, 2004)

 

Vice Chair Moylan made a motion on Item #2003-0913 to continue to February 9, 2004.  Comm. Simons seconded.  Motion carried 7-0.

 

APPEAL OPTIONS: Item may be appealed to City Council.

 

2. 2003-0753 - Nextel Communications [Applicant] Crown Castle International [Owner] - Application for a Use Permit on a 2.9-acre site to allow a sixth co-location of twelve panel antennae on an existing monopole.  The property is located at 375 North Pastoria Avenue in an M-S (Industrial & Service) Zoning District.  (APN: 165-30-019) (Negative Declaration) CC

 

Comm. Hungerford made a motion on Item #2003-0753 to adopt the Negative Declaration and approve the Use Permit with modifications: 1) add Condition of Approval #15 to state that "an equipment screen that is visually compatible with the surrounding neighborhood shall be installed to conceal the equipment located at the base of the monopole from view.  The design of the screen shall be reviewed and approved by the Director of Community Development prior to the issuance of the Building permit" and 2) that the applicant enter into an agreement with the property owner to share in any expense requirement relative to future pole enhancements required by the Director of Community Development.  Comm. Fussell seconded. Motion carried 6-1 with Vice Chair Moylan dissenting.

 

APPEAL OPTIONS: Item may be appealed to City Council no later than 02/10/04

 

3. 2002-0612 - City of Sunnyvale - Rezone specific properties from R-3/PD (Medium Density Residential) to R-2/PD (Low-Medium Density Residential) to bring the properties into conformance with the General Plan Designation of Low-Medium Density Residential (7-14 du/acre) which was adopted by the City Council on June 17, 2003. (APNs: 209-04-028 thru 035; 209-05-023 thru 028; 209-10-026 thru 028; 209-10-030; 209-10-037 thru 041; 209-10-065 and 209-10-066) (Environmental review was conducted in a previous Environmental Impact Report certified on June 17, 2003.) (Also to City Council on 02/10/04)

 

Vice Chair Moylan made a motion on Item #2002-0612 to recommend to City Council to Introduce an Ordinance to amend the Zoning Designation of the eastern adjacent site around the Downtown Specific Plan from R-3/PD to R-2/PD in accordance with staff recommendation.  Comm. Hungerford seconded.  Motion carried 7-0.

 

APPEAL OPTIONS:  Item will be considered by City Council.

 

4. 2003-0076 - City of Sunnyvale - Green Buildings - Adoption of polices and an ordinance to promote and create incentives for sustainable development in the disciplines of: sustainable sites, water efficiency, energy and atmosphere, materials and resources and indoor environmental quality. (Negative Declaration) EW (Also to City Council on 02/03/04)

 

Vice Chair Moylan made a motion on Item #2002-0076 to recommend to City Council Alternative #1 to adopt a policy and ordinance pertaining to Floor Area Ratio on Sustainable Development Buildings and Alternative #3 to direct staff to continue to monitor the green building industry, what other cities do and the LEED program and report back to Council with updates and recommendations within five years or sooner when necessary with modification to include in the policy "consideration of recyclability of construction materials." Comm. Hungerford seconded.  Motion carried 7-0.

5. Discussion and Adoption of the 2004 Work Plan

 

Comm. Simons made a motion to Adopt the 2004 Work Plan.  Comm. Klein seconded.  Motion carried unanimously 7-0.

Oral Communications

 

Report on Council Meeting

 

Ms. Ryan reported that on the City Council meeting of 01/13/04, the Neighborhood Preservation Division presented its Neighborhood Presentation Program update. The presentation demonstrated before and after results of properties that are non-compliance and staff's efforts in enforcing city ordinances. 

 

Planning Officer’s Report

 

Ms. Ryan announced that Diana O'Dell has been promoted to Senior Planner.  She noted that this is the second time Ms. O'Dell has been able to take advantage of the flexible planner classification.

 

Ms. Ryan further reported that there are administrative changes in the Planning Division.  Fred Bell, Principal Planner will oversee current planning and Gerri Caruso, Principal Planner, will oversee community planning and act as the Administrative Hearing Officer with her first hearing scheduled on Wednesday.  Ms. Ryan also added that Ms. Caruso will assist in the administrative role of the Planning Officer.
