COMMUNITY DEVELOPMENT DEPARTMENT

OFFICE MEMORANDUM

DATE: February 24, 2004

TO: Mayor and Members of the City Council

FROM: Robert Paternoster, Community Development Director

THROUGH: Amy Chan, Acting City Manager

RE: Pre-Appeal Report

PLANNING COMMISSION 03-8-04
ADMINISTRATIVE HEARING 03-10-04

Attached is the "Pre-Appeal Report" in the new format, which is presented as a "Draft Agenda" for future Planning Commission and Administrative Hearing items.  Please note that there are no items in the March 8, 2004 Planning Commission Agenda that can be pre-appealed by City Council.

Please note that a majority of the Council members must vote in favor of a pre-appeal. Council should specify the reason for the pre-appeal and indicate any appealed items on which it wishes to have expanded notification.

Also note that, in response to budget saving measures, the City Council agenda for February 24, 2004 also includes an item to amend Title 19 (Zoning). The amendments include the elimination of the “Pre-Appeal” options. If the City Council introduces the ordinance on February 24, 2003, the ordinance could become effective on April 1, 2004

If you have any questions, please contact Trudi Ryan, the City's Planning Officer, at (408) 730-7435.
