SUBJECT: Award of Bid #F0311-30 for Ortega Park Improvements

REPORT IN BRIEF

Approval is requested for the award of a contract to J. W. Riley and Sons, Inc., of Oakland to construct improvements at Ortega Park for the Department of Public Works Engineering Division Project Administration (Project #PR-01/03-04).

BACKGROUND

The Ortega Park Improvement Project is part of the Parks and Recreation 20-year playground infrastructure improvement plan.  The scope of work for this project includes removing and replacing all existing playground equipment which is worn out and no longer meets safety standards; repairing hardscapes surrounding and between buildings and the play area; removing stairs, steps, etc., to make the facility more accessible to disabled citizens; and replacing the existing resiliant surface materials. 

DISCUSSION

Bid specifications were prepared by Public Works and Purchasing staff.  The bidders were required to submit a Base Bid for the construction of drainage equipment, play structures, climbing wall, swing set, water play equipment, paving, steps, walls, curbs, site furnishings and irrigation and planting preparation, and two Additive Alternates. Additive Alternate #1 consisted of the construction of mulched planting beds and concrete paving at areas surrounding the existing buildings.  Additive Alternate #2 consisted of construction of a "tot lot" play structure using volunteer installers provided by the City. 

The Notice Inviting Bids was published in The Sun on November 19, 2003.  The bid package was distributed to Bay Area Builders Exchanges and broadcast to potential contractors through the DemandStar by Onvia procurement network.  Thirty-two contractors requested bid documents.

 

Sealed bids were publicly opened on December 17, 2003; six responsive bids were received:

Staff recommends the acceptance of the Base Bid and Additive Alternates #1 and #2 from J. W. Riley and Sons, Inc., the lowest responsive and responsible bidder.  The additive alternates are important components of the total design and were separated from the Base Bid only to ensure that most of the project could be completed, without delay, should bids come in higher than budget.  Fortunately, that did not occur; and staff recommends completion of the entire project at this time.

A determination was made that this project will have no significant effect on the environment in accordance with CEQA guidelines for categorically exempt projects.

RECOMMENDATION

It is recommended that Council:

1. Award a contract, in substantially the same form as the attached draft and in the amount of $517,500, to J. W. Riley and Sons, Inc., for the Base Bid and Additive Alternates #1 and #2 for the Ortega Park Improvement Project; and

2. Approve a project contingency in the amount of $51,750.
