ORDINANCE NO. 2752-04

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SUNNYVALE AMENDING THE PRECISE ZONING PLAN, ZONING DISTRICTS MAP, TO REZONE A 33,153 SQUARE FOOT SITE LOCATED AT 612 AND 616 EAST AHWANEE AVENUE FROM R-2/PD (LOW MEDIUM DENSITY RESIDENTIAL/PLANNED DEVELOPMENT) TO R-3/PD (MEDIUM DENSITY RESIDENTIAL/ PLANNED DEVELOPMENT) ZONING DISTRICT

          THE CITY COUNCIL OF THE CITY OF SUNNYVALE DOES ORDAIN AS FOLLOWS:

          SECTION 1.  AMENDMENT OF PRECISE ZONING PLAN.  The Precise Zoning Plan, Zoning Districts Map, City of Sunnyvale (Section 19.16.070 of the Sunnyvale Municipal Code) hereby is amended in order to include certain properties within   the R-3/PD (MEDIUM DENSITY RESIDENTIAL/PLANNED DEVELOPMENT) which properties are presently zoned R-2/PD (LOW MEDIUM DENSITY RESIDENTIAL/PLANNED DEVELOPMENT).  The location of the properties is set forth on the scale drawing attached as Exhibit “A.”

SECTION 2.  CEQA COMPLIANCE. As part of the process of updating the Downtown Improvement Program, the City has analyzed the environmental effects of this ordinance, certified a Program Environmental Impact Report and a Mitigation Monitoring and Reporting Program on June 17, 2003, and made necessary findings required by the California Environmental Quality Act (Public Res. Code §§ 21000 et seq.; "CEQA"). The City finds that the adoption of this ordinance is within the scope of the program EIR and no new environmental documentation is required.

          SECTION 3.  EFFECTIVE DATE.  This ordinance shall be in full force and effect thirty (30) days from and after the date of its adoption.

          SECTION 4.  PUBLICATION.  The City Clerk is directed to cause a copy of this ordinance to be published at least once within fifteen (15) days after its adoption in The Sun, the official newspaper of the City of Sunnyvale.
