A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SUNNYVALE UPDATING ITS LOCAL CALIFORNIA ENVIRONMENTAL QUALITY ACT IMPLEMENTING PROCEDURES BY ADOPTING THE STATE CEQA GUIDELINES WITH CERTAIN MODIFICATIONS
WHEREAS, the California Environmental Quality Act (“CEQA”) (Public Resources Code §§ 21000 et seq.) and the State CEQA Guidelines (Cal. Code of Regs., Title 14, §§ 15000 et seq.) provide that local agencies must adopt procedures to implement the provisions of CEQA; and
WHEREAS, the City adopted implementing procedures in accordance with this mandate, most recently in 1986, through Resolution No. 193-86, and
WHEREAS, the City now desires to update its implementing procedures and desires that they be consistent with the current provisions of CEQA and the State CEQA Guidelines and remain so on a continuing basis; and
WHEREAS, Section 15022 of the State CEQA Guidelines permits the City to adopt the State Guidelines, as amended from time to time, as its implementing procedures through incorporation by reference.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SUNNYVALE THAT:
1. Resolution No. 193-86 is hereby repealed.
2. The State CEQA Guidelines adopted by the Secretary of the Resources Agency of the State of California are incorporated by reference and hereby adopted as the implementing procedures required by CEQA. All future revisions to the State CEQA Guidelines shall hereafter be considered a part of the City’s implementing procedures without further action by the City Council.
3. The State CEQA Guidelines are augmented by the implementing procedures set forth in Exhibit “A” attached and incorporated by reference.
