SUBJECT: AWARD OF CONTRACT TO PROVIDE ACTING DIRECTOR OF PUBLIC SAFETY SERVICES
REPORT IN BRIEF
Approval is requested for the award of a contract to RVB Consulting, LLC to provide the services of Robert Bradshaw to serve as Acting Director of Public Safety.
EXISTING POLICY
Section 2.08.070 of the Sunnyvale Municipal Code exempts from competitive bidding contracts involving the obtaining of professional or specialized services.
BACKGROUND
Mike Maehler’s last day as Acting Director of Public Safety will be June 2, 2004. Until the return of our regular Director of Public Safety, it is necessary to provide for acting director services. The recommended contract is for a maximum period of one year. This is a sufficient amount of time to determine the status of the existing Director of Public Safety and to conduct a recruitment to find a regular replacement should that be necessary.
DISCUSSION
Approval is requested for the award of a contract to RVB Consulting, LLC effective June 1, 2004. RVB Consulting will engage the exclusive services of Robert Bradshaw to serve as Acting Director of Public Safety. Mr. Bradshaw has over 40 years of law enforcement experience. His assignments have included: Police Chief in Reno, Nevada (June 1981 to July 1991), Assistant Police Chief in San Jose (February 1979 to June 1981) and an officer in San Jose since 1960. His more recent assignments include: Police Chief at Concord (August 1995 to November 1999), Interim Chief, State of Nevada, Highway Patrol (October 1993 to September 1994), and Interim Chief of Concord (April 1992 to April 1993). He has a Masters Degree of Public Administration from Golden Gate University and BA Degree from San Jose State University. Mr. Bradshaw is well known for his expertise in community policing.
He is also experienced in labor relations, and is very familiar with outcome management and performance budgeting from his time at City of Concord.
RVB Consulting will be paid $150 per hour for their services. Payment will be based on actual hours providing services which are estimated not to exceed 1850 hours under this contract. In addition, the contract provides for reimbursement of up to $5,000 of temporary residence expenses agreed to by the City Manager. The existing salary resolution provides for up to $5,000 of relocation assistance for classified management (non-department director) employees.
FISCAL IMPACT
It is estimated that the contract cost to the City will not exceed $282,500, all of which is included within the existing Department of Public Safety budget. The fully burdened salary and benefit rate for the Director of Public Safety included in the FY 2004-2005 budget is $155.89 per hour.

Public contact was made through posting of the Council agenda on the City's official notice bulletin board, posting of the agenda and report on the City's web page, and the availability of the report in the Library and the City Clerk's Office.
ALTERNATIVES
1. Award the contract to RVB Consulting, LLC to provide the services of Robert Bradshaw as Acting Director of Public Safety effective June 1, 2004 at the hourly rate of $150 plus temporary residence expenses as approved by the City Manager.
2. Do not award the contract to RVB Consulting, LLC and staff this position using other means.
RECOMMENDATION
Staff recommends Alternative 1 above, accepting the contract with RVB Consulting, LLC.
