SUBJECT: Approval of Final Map – Sun Pacific Townhomes - Tract No. 9538
REPORT IN BRIEF
It is recommended that the City Council approve the final map for Tract No. 9538, accept all easements offered for dedication as shown on the map, certify the abandonment of an anchor easement, execute the subdivision agreement and accept the surety bonds for the subject subdivision project. The final map for Tract No. 9538 is substantially the same as the tentative map. The subdivider has executed the subdivision agreement, provided surety bonds, paid development fees and furnished all other necessary documents to the City.
BACKGROUND
Tract No. 9538 is a 24-unit townhouse project at 759 and 775 Carmel Ave. The tentative map was approved by the Planning Commission at its April 28, 2003 meeting and by the City Council at its May 13, 2003 meeting.

DISCUSSION
The final map for Tract No. 9538 has been examined by the Public Works Department staff and found to be in conformance with Sunnyvale Municipal Code Title 18 Subdivision and the State of California “Subdivision Map Act” applicable at the time of approval of the tentative map. The property owner has executed the subdivision agreement and posted surety bonds ($173,000.00 for faithful performance and $173,000.00 for labor and material) to guarantee completion of all public improvements. The development fees and other related documents have also been furnished to the City and found to be complete and in proper form.
As part of the conditions of approval of the subject project, the developer shall underground existing overhead utility service lines. Consequently, an existing Anchor Easement (A.E.) must be abandoned by the City on the final map as directed and acknowledged by PG&E. Pursuant to Subdivision Map Act Section 66499.20½, the filing of the final map constitutes such abandonment of an easement for public use.
RECOMMENDATION
It is recommended that the City Council approve the final map, accept all easements offered for dedication as shown on the map, certify the abandonment of an anchor easement, execute the subdivision agreement and accept the surety bonds for Tract No. 9538.
