A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SUNNYVALE AMENDING RESOLUTION NO. 125-03, THE CITY'S FEES, RATES AND CHARGES RESOLUTION, PERTAINING TO TEMPORARY TRAFFIC CONTROLS
WHEREAS, on June 17, 2003, the City Council adopted Resolution No. 125-03 fixing and establishing fees, rates, and charges for goods and services provided by the City of Sunnyvale; and
WHEREAS, in Fiscal Year 2002/03, the City incurred over 750 hours and $32,000 in costs providing emergency and non-emergency temporary traffic controls in the City, including over 200 different scheduled non-emergency events which account for almost two-thirds of the costs;
WHEREAS, staff reviewed the potential for cost recovery and has recommended that Section 8.11 of the 2003/04 Master Fee Schedule be amended to revise the existing fees for City services associated with the setup and breakdown of temporary traffic controls during non-City sponsored events; and
WHEREAS, these fees were recommended as a new revenue source in the final FY 2003/04 Budget approved by the City Council in June 2003;
WHEREAS, the City Council is empowered to impose reasonable fees, rates, and charges to offset the costs for municipal services;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SUNNYVALE THAT:
1. Section 8.11 of the Master Fee Schedule, entitled “Barricades, Traffic Cones,” is hereby deleted and replaced in its entirety with a new Section 8.11 entitled “Traffic Control Fees,” to establish the schedule of charges for non-emergency, planned events, as set forth in Exhibit "A", attached hereto and incorporated herein,
2. All other provisions of Resolution No. 125-03 shall remain in effect.
3. This resolution shall take effect upon adoption.
