SUBJECT: Award of Bid No. F0303-54 for the Construction of the Sunnyvale Bicycle Network (Phase 2)
REPORT IN BRIEF
Approval is requested for the award of a contract to Chrisp Company of Fremont for the construction of the second phase of the Sunnyvale Bicycle Network for the Department of Public Works Engineering Division Project Administration Section (Project No. TR-00/01-02).
BACKGROUND
In 1999, Council authorized submittal of a grant application for a candidate bicycle project for Federal TEA-21 Funding. Subsequently, a grant in the amount of $310,000 was approved for construction of bike lanes on 6.2 miles of City streets. A high initial Engineer's Estimate for this work resulted in phasing of the project to assess the bidding climate. Bids for the first phase of the project came in well below the Engineer's Estimate, and the first phase is now complete. Staff recommends proceeding with the second phase of bike lane construction work to expend the remaining federal grant funds.
DISCUSSION
Bid specifications for Phase 2 were prepared by Public Works and Purchasing staff. The bid was structured so that the Base Bid (Bid Items A and B) included Crossman Avenue from Caribbean to Java and Knickerbocker from El Camino Real to Mango. The first Additive Alternate (Bid Item C) included Santa Trinita from Stewart to Arques, and the second Additive Alternate (Bid Item D) included Hollenbeck from Alberta to Homestead.
The Notice Inviting Bids was published in The Sun on March 17, 2004; and the bid package was distributed to Bay Area Builders Exchanges and broadcast to potential contractors through the DemandStar by Onvia public procurement network. Five contractors requested bid documents.
Sealed bids were publicly opened on April 7, 2004. Two responsive bids were received.

Staff recommends the acceptance of the Base Bid, Additive Alternate C and Additive Alternate D from Chrisp Company of Fremont, the lowest responsive and responsible bidder.
A determination was made that this project will have no significant effect on the environment in accordance with CEQA guidelines for categorically exempt projects.

Funds in the amount of $119,169 are available in Capital Project 821560 - Sunnyvale Bicycle Network, which is funded by TEA21 and Transportation Development Act grant monies. Any remaining contingencies would be covered by Transportation Operations Program funds which are budgeted specifically for discretionary bicycle-related expenditures.
RECOMMENDATION
It is recommended that Council:
1. Award a contract, in substantially the same form as the attached draft and in the amount of $104,642, to Chrisp Company for the construction of the Sunnyvale Bicycle Network (Phase 2); and
2. Approve a project contingency in the amount of $15,696.
