Attached is the "Appeal Report" which is presented as an annotated agenda ("ACTION SUMMARY") noting which items may be appealed and the final appeal date.  Staff reports and detailed minutes are available on the City’s web site and one set of reports and minutes will be placed in a binder in the Council Office. 

 

Council should specify the reason for an appeal and indicate any appealed items on which it wishes to have expanded notification.

DRAFT MINUTES
 SUNNYVALE planning commission

 

The Planning Commission met in regular session in the Council Chambers, City of Sunnyvale, 456 W. Olive Avenue, Sunnyvale, CA on April 26, 2004 at 8:00p.m. with Chair Babcock presiding.

 

ROLL CALL

 

Members Present: Chair Laura Babcock, Vice Chair Christopher Moylan, Commissioner Jim Fussel, Commissioner Chuck Hungerford, Commissioner Larry Klein, Commissioner David Simons and Commissioner Brandon Sulser

Vice Chair Moylan made a motion to approve the minutes of April 12, 2004.  Comm. Klein seconded.  Motion carried 5-2 with Comms. Fussell and Simons abstaining.

PUBLIC HEARINGS/GENERAL BUSINESS

1.   2000-0523- City of Sunnyvale – Introduction of an Ordinance, Chapter 19.29 Moffett Park Specific Plan and associated amendments to the Zoning Ordinance (Environmental Impact Report was certified November 11, 2003) KDI (Continued from April 12, 2004)

ACTION:  Comm. Simons made a motion on Item #2003-0523 to recommend to City Council to introduce the Zoning Ordinance, Chapter 19.29 Moffett Park Specific Plan and other associated amendments to the Zoning Ordinance with modification to Table 19.29.060 8A to state public transportation facilities except for stops and stations which could be considered as Miscellaneous Plan Permit.  Motion carried unanimously 7-0.

APPEAL OPTIONS:  Not appealable, item to be considered by City Council on May 11, 2004.

NON-AGENDA ITEMS AND COMMENTS

 

·         COMMISSIONERS ORAL COMMENTS

 

Comm. Simons congratulated the Sunnyvale Historic Society on a very successful rained-out fund raiser walkathon event.

 

Chair Babcock announced that the event raised a little over $29,000 which will be matched by the McKenna Foundation.  She thanked the public who participated and supported the event.

·         City Council Meeting Report

 

Ms. Ryan reported that on April 20, the City Council discussed a mayor’s task force on car dealerships.  She noted that Chair Babcock participated in this task force.  She further reported that there were a number of items evaluated and some of the activities are review a decorative banner program and permissible signage.  A staff report was presented to City Council which identifies possibilities for prioritizing staff’s workload.  She will let the Commission know if there would be some modifications to the study issue ranking for this year.

 

Further, she reported that on April 17, the City Council received budget information on Funds and Programs with a look at different service areas.  She noted that the Council did not take any action but has submitted the information to City Manager for budget consideration.

 

·         Other Staff Oral Report

 

Ms. Ryan announced that the City is actively recruiting to fill vacant positions on the Boards and Commissions.  She noted that the application deadline is on Friday, May 21 at 5PM.  For further information, she invited the public to visit the City’s website at www.sunnyvale.ca.gov or contact Donna Biles at 730-7595.

 

She also announced the next Planning Commission Downtown Community Outreach Meeting on Thursday, April 29 at 7PM to be held at The Historic Del Monte Building, 100 S. Murphy Avenue. She noted that flyers have been distributed and that free parking facilities are available around downtown such as CalTrain Parking garage, surface parking lots near Macy’s and underground parking under the plaza construction sites.  She encouraged the public to participate.  She stated that the purpose of the meeting is for the community to hear the applicant’s proposal and provide comment to the applicant.

 

She also noted that the April 7 Community Outreach Meeting held at the Community Center is being replayed at KSUN on Monday thru Friday at 4PM, Thursday and Friday at 8PM and Saturday at 10AM.

A public hearing was held by the Administrative Hearing Officer at 2:00 p.m. in the West Conference Room, City Hall, 456 W. Olive Avenue, Sunnyvale, CA for the purpose of considering the following application:     

 

1.  2004-0252 - Application for a Variance from SMC (Sunnyvale Municipal Code) Section 19.14.060 (A)(4) to allow a one car garage where a two car garage is required for single family homes exceeding 1,800 square feet.  The property is located at 777 The Dalles in an R-1 (Low Density Residential) Zoning District.  (APN: 323-15-038) DO

 

ACTION: Approved

 

APPEAL OPTIONS: May be appealed to the Planning Commission by Thursday, May 13, 2004.

 

2.   2004-0217 - Howard Krawetz [Applicant] Lockheed Missiles & Space Co., Inc. [Owner]: Application for a Use Permit on a 7.5 acre site to allow a monthly flea market.  The project is located at 1111 Lockheed Way (between 9th and 11th Streets) in an M-3 (General Industrial) Zoning District. (APN:  110-01-025) EW

 

ACTION: Approved with Modification

3.   2004-0249 - Abigail O’Connell [Applicant] Lucerne Properties, LLC. [Owner]: Application for a Use Permit on a 1.61 acre site to allow a ceramic art studio and pottery classes in an industrial building.  The property is located at 790 Lucerne Drive in an M-S (Industrial & Service) Zoning District. (APN:  205-32-005) SL

 

ACTION: Approved with Modification

 

APPEAL OPTIONS: May be appealed to the Planning Commission by Thursday, May 13, 2004.

 

4.      2004-0193 - Richard Jacobs [Applicant/Owner]: Application for a Use Permit on a 19,092 square foot site to allow a trash enclosure within the required front yard setback.  The property is located at 649 Blythe Court in an R-3 (Medium Density Residential) Zoning District.  (APN: 205-01-002) RK

 

ACTION: Application taken under advisement on Wednesday, April 28, 2004.

Use Permit denied on Monday, May 3, 2004.
