SUBJECT: Award of Bid No. F0301-44 to Remodel the Restrooms at Six Sunnyvale Parks

REPORT IN BRIEF

Approval is requested for the award of a contract to William G. Fritz doing business as W. G. Fritz Construction of San Jose for the Sunnyvale Park Restroom Remodel Project for the Department of Parks and Recreation Facilities Management Division.

BACKGROUND

The scope of this project is to provide miscellaneous repairs, code-related modifications and handicap accessibility to restroom facilities at six City parks: Lakewood, Fair Oaks, Ortega, Serra Park, Los Palmas and Ponderosa. The project will be scheduled in two phases, with each phase consisting of completion of work on three parks facilities. The scope of services includes a provision that the contractor provide temporary restroom facilities at each site while the work is in process.

DISCUSSION

Bid specifications were prepared by Facilities and Purchasing staff. Bids were distributed directly to eight South Bay general contractors and broadcast to other potential contractors through the DemandStar by Onvia procurement network. Eleven contractors requested bid documents.

Sealed bids were publicly opened on April 28, 2004. Two bids were received.

The low bid from Hollander Smith was valid for only ten days (the specifications called for sixty days) and is, therefore, non-responsive. Staff recommends acceptance of the bid from W. G. Fritz Construction, the lowest responsive and responsible bidder.

RECOMMENDATION

It is recommended that Council:

1.

Award a contract, in substantially the same form at the attached draft and in the amount of $221,768, to William G. Fritz doing business as W. G. Fritz Construction for the Park Restroom Remodel Project; and

2.

Approve a project contingency in the amount of $33,265.
