A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SUNNYVALE APPROVING A FISCAL YEAR 2003-2004 VOLUNTARY LEAVE OF ABSENCE PROGRAM FOR NOVA EMPLOYEES

WHEREAS, in October 2003, NOVA recognized it might experience difficulty in securing the amount of grant funding needed to operate its program for the full 2003-2004 fiscal year; and

WHEREAS, meetings have occurred with City representatives and representatives of the Sunnyvale Employees Association (SEA) and the Service Employees International Union, Local 715 (SEIU), and the parties have reached an agreement on the implementation of a voluntary leave of absence program for NOVA employees related to the Fiscal Year 2003-2004 Funding Gap; and

WHEREAS, a Voluntary Leave of Absence Program has been recommended so that full-time and regular part-time employees may elect to take paid leave (accrued vacation or paid time off (PTO)) or unpaid leaves of absence, the key elements of which are set forth in the Program Guidelines, attached as Exhibit "A", in order to bridge the funding gap and avoid layoffs;

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SUNNYVALE THAT the Fiscal Year 2003-2004 Voluntary Leave of Absence Program for NOVA employees, as set forth in Exhibit "A", is hereby approved.
