SUBJECT: Award of Contract to Provide Interim Director of Public Safety Services
REPORT IN BRIEF
This report requests approval for the award of a contract to PD Solutions to provide the services of Patrick Dwyer to serve as Interim Director of Public Safety.
BACKGROUND
An executive recruitment is currently underway to fill the position of Director of Public Safety and the recruitment is expected to be complete by January 2005. Until the recruitment is complete, it is necessary to retain the services of an Interim Director of Public Safety. Patrick Dwyer of PD Solutions is highly qualified to serve in that capacity.
EXISTING POLICY
Section 2.08.030 of the Sunnyvale Municipal Code exempts from competitive bidding contracts involving the attainment of specialized services.
DISCUSSION
Approval is requested for the award of contract to PD Solutions, which renders the services of Patrick Dwyer to serve as Interim Director of Public Safety. The services provided by Patrick Dwyer are set forth in Attachment A, Consultant Services Agreement Between the City of Sunnyvale and PD Solutions.
Mr. Dwyer served a long and distinguished career in the City of San Jose, after which he served as the Chief of Police in the City of Palo Alto until his retirement in 2003. Since his retirement from the City of Palo Alto, Mr. Dwyer also provided professional services to the City of Hayward as the Interim Chief of Police.
FISCAL IMPACT
The Director of Public Safety is included in the FY 2004-2005 budget at a fully burdened salary and benefit rate of $155.89 per hour. The cost of this contract with PD Solutions is $6,000 per week, which is equivalent to $150 per hour for a 40-hour week.

Public Contact was made through posting of the Council agenda on the City’s official notice bulletin board, posting of the agenda and report on the City’s web page, and the availability of the report in the Library and the City Clerk’s Office.
ALTERNATIVES
- Award contract to PD Solutions to provide the services of Patrick Dwyer as Interim Director of Public Safety.
- Do not award the contract to PD Solutions, and staff this position using other means.
RECOMMENDATION
Recommend approval of Alternative No. 1.
