RESOLUTION NO. _______
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SUNNYVALE RESCINDING RESOLUTION NO. 153-03 PERTAINING TO A STATEWIDE BALLOT INITIATIVE TO REQUIRE VOTER APPROVAL BEFORE STATE GOVERNMENT MAY TAKE LOCAL TAX FUNDS
WHEREAS, on November 11, 2003, the City Council passed Resolution No. 153-03 expressing its strong support for a statewide ballot initiative (which later became known as Prop 65) to allow voters to decide whether local tax funds may be taken, confiscated, shifted, diverted or otherwise used to fund state government operations and responsibilities, and authorized staff to provide impartial informational materials on the initiative as may be lawfully provided by the City’s representatives with no public funds being used to campaign for or against the initiative; and
WHEREAS, the City Council encouraged the residents of the City to become well informed on the initiative and its possible impacts on the critical local services on which they rely and directed the City Clerk to send a copy to the Executive Director of the League of California Cities; and
WHEREAS, staff is now recommending that the City Council now oppose this initiative;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SUNNYVALE THAT the City Council hereby rescinds Resolution No. 153-03 and the City Clerk is hereby directed to send a copy to the Executive Director of the League of California Cities.
