SUBJECT: Child Care Advisory Board Regular Meeting Cancelled Due to Lack of Quorum – Information Only
REPORT IN BRIEF
The purpose of this report is to notify City Council that the City of Sunnyvale’s Child Care Advisory Board’s (CCAB) Regular Meeting scheduled for October 7, 2004, was cancelled due to lack of quorum. By October 5, 2004, three of the six CCAB members had notified staff that they would be absent for this meeting, resulting in a lack of quorum. This meeting has been rescheduled to October 21, 2004, at which time the CCAB will consider alternate days and times for their regular meetings (the Community College Representative on the CCAB has a new teaching schedule that conflicts with the current CCAB meeting time). Staff recommends that Council direct staff to assist the CCAB with identifying alternate meeting times for their regular meetings.
BACKGROUND
The Child Care Advisory Board (CCAB) meets on the first Thursday of each quarter from 1-3 p.m. Six of the seven seats on the CCAB are currently filled. Staff is working on recruiting a seventh CCAB member.
EXISTING POLICY
Administrative Policy, Quorum Policy, Article XV, Section 4. In situations where a Board has less than a quorum at a regularly scheduled meeting, Board staff are to notify Council by submitting an information report to be placed on the Council agenda within 10 days, discussing the reason for the lack of quorum, the members in attendance and absent, a three month history of attendance and staff's observation of whether there may be a continuing problem. Council will decide on the appropriate follow-up, if any. In "no quorum" situations, Boards may not take official actions and no minutes shall be published.
DISCUSSION
Reason for Lack of Quorum
The following CCAB members notified staff that they would be absent at the October 7, 2004 CCAB Regular Meeting for the following reasons:
- Emily Gutierrez, (Vice-Chair), Parent Representative, was out of town on personal business.
- Hilal Ozdemir, Community College Representative, has conflicts with her new teaching schedule and the CCAB meeting time. The CCAB will consider a new meeting day and time at their October 21, 2004 meeting.
- Jacque Sell, Child Care Center Representative, was out of town on work-related business.
The following CCAB members notified staff that they would be present at the October 7, 2004 CCAB Regular Meeting:
- Angela Carmack, Community Care Licensing Representative
- Carole Jevons, (Chair) Family Child Care Representative
- Maxine Shea, Related Field Representative
Three Month History of Attendance
The Child Care Advisory Board’s last regular meeting was on July 1, 2004. Attendance was as follows:

- Emily Gutierrez, (Vice-Chair),Parent Representative – Present
- Carole Jevons, (Chair), Family Child Care Representative) – Present
- Hilal Ozdemir, Community College Representative – Absent (Excused)

Staff Observation of CCAB Attendance
Staff believes that the CCAB members are committed to attending CCAB meetings and that the lack of quorum issue will be resolved when alternate meeting times are considered at the October 21, 2004 meeting.
FISCAL IMPACT
There is no fiscal impact resulting from the recommendation in this report.
CONCLUSION
The Child Care Advisory Board meeting scheduled for October 7, 2004 was cancelled due to lack of quorum. This meeting has been rescheduled to October 21, 2004, at which time alternate meeting times will be considered. Staff believes that the CCAB members are committed to attending CCAB meetings and that lack of quorum is not likely to be an issue at future meetings.

Public contact was made through posting of the Council agenda on the City’s official notice bulletin board, posting on the agenda and report on the City’s web page, and publication of the Council agenda in the San Jose Mercury News.
ALTERNATIVES
Direct staff to assist the CCAB with identifying alternate meeting times for CCAB regular meetings to help ensure that quorum will be reached at future meetings.
Other alternatives as directed by Council.
RECOMMENDATIONS
Staff recommends Alternative #1 as described above.
