RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY

OF SUNNYVALE APPOINTING JOAN A. BORGER INTERIM

CITY ATTORNEY

          WHEREAS, Section 900 of the Charter of the City of Sunnyvale provides that the City Attorney shall be appointed by the City Council; and

          WHEREAS, it is the desire of the City Council to appoint an Interim City Attorney and to provide certain benefits, establish certain conditions of service and to set working conditions.

          NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SUNNYVALE THAT:

          1.  It appoints Joan A. Borger Interim City Attorney of the City of Sunnyvale, effective October 15, 2004.

          2.  The salary of the Interim City Attorney shall be the control point for the D-2 level department director position of $156,520.00 per year, in accordance with Resolution No. 131-04.

          3.   The Interim City Attorney shall be entitled to retirement and other benefits in accordance with the terms and conditions of the Employment Agreement between City of Sunnyvale and Joan A. Borger, Interim City Attorney.

          BE IT FURTHER RESOLVED that the Interim City Attorney shall also fill the position of Interim General Counsel of the Redevelopment Agency of the City of Sunnyvale.

          Adopted by the City Council of the City of Sunnyvale at a regular meeting held on October 19, 2004, by the following vote:
