SUBJECT: 2004 City’s Conflict of Interest Code Biennial Review and Amendment
REPORT IN BRIEF
Pursuant to requirements of the Political Reform Act, the City has conducted a biennial review of its Conflict of Interest Code and has determined that an amendment is necessary to the current Code. The proposed amendments are due to recent changes to designated positions. Staff requests the Council to adopt the attached resolution amending the Code.
BACKGROUND
The Political Reform Act requires every local government agency to review its conflict of interest code biennially to determine if the Code is accurate, or alternatively, that the Code must be amended. If a determination is made to amend the Code, the City’s amended Code is not effective until it has been approved by the City Council.
EXISTING POLICY
Council Legislative Policy No. 7.3.4: Legislative Management – Standard Conflict of Interest Code addresses procedures developed in compliance with the Political Reform Act (attached).
DISCUSSION
The City’s Conflict of Interest Code was last amended on October 22, 2002. Since that date, positions have been amended in the City’s classification plan and salary resolution. Exhibit A to the attached resolution includes these changes, noted accordingly. Each of the individuals holding the positions designated in the Code are subject to filing a Statement of Economic Interests Form 700 with the City Clerk.
FISCAL IMPACT
There is no fiscal impact as a result of this action.
CONCLUSION
In its review, staff has determined that amendments to the City’s Conflict of Interest Code are necessary. Attached is a resolution adopting a proposed amended Code for Council consideration.
PUBLIC CONTACT
Public contact was made through posting of the Council agenda on the City’s official notice bulletin board, posting of the agenda and report on the City’s web page, and the availability of the report in the Library and the City Clerk’s office.
ALTERNATIVES
Adopt the resolution amending the City’s Conflict of Interest Code, in conformance with the California Government Code.
Do not adopt the resolution amending the Code.
RECOMMENDATION
It is recommended that the City Council adopt the resolution amending the City’s Conflict of Interest Code.
