A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SUNNYVALE REVISING THE EMERGENCY PLAN AND STANDARDIZED RESPONSE SYSTEM FOR THE CITY

          WHEREAS, Government Code Sections 8568 and 8607 and Sunnyvale Municipal Code Section 2.16.080 requires the City to develop and maintain an Emergency Plan that provides for effective mobilization of all resources of the City, both public and private, to meet any condition constituting a Local Emergency, State of Emergency or State of War Emergency in order to obtain any funding of response-related costs; and

          WHEREAS, on February 27, 1996, in accordance with Government Code Sections 8568 and 8607 and Sunnyvale Municipal Code Section 2.16.080, the City Council adopted, by Resolution No. 117-96, an Emergency Plan and Standardized Response System; and

          WHEREAS, staff has proposed a revised Emergency Plan and Standardized Response System to supersede the City's existing Emergency Plan in order to meet current local, State and Federal standards and, in particular, to comply with the Standardized Emergency Management System (SEMS) as required by Government Code 8607(a) and to conform to the requirements of the National Incident Management System (NIMS) as mandated by FEMA;

          NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SUNNYVALE HEREBY RESOLVES AS FOLLOWS:

          Section 1.      That the City of Sunnyvale Emergency Plan and Standardized Response System dated March 29, 2005, a copy of which is now on file in the Office of the City Clerk and which is incorporated herein by reference, is hereby approved and adopted as the Emergency Plan and  Standardized Response System for the City.  The Director of Emergency Services shall keep the Plan and Response System current.

          Section 2.      The Emergency Response Plan and Standardized Response System dated March 29, 2005, supersedes the Emergency Plan and Response System for the City which was adopted by Resolution No. 117-96, and that the former shall be of no further force and effect.
