REPORT IN BRIEF

The Interim Human Resources Director is projected to reach the maximum hours (960) of employment, based on a calendar year, after retirement by June 17, 2005.  The City has recently concluded the first part of the recruitment and has an anticipated start date for a permanent director of August 8, 2005.  Therefore Jane Fleenor, the Interim Human Resources Director, has agreed to remain employed until July 28, 2005.  The City would, therefore, request PERS to allow the maximum hours to be exceeded by 260 hours.

BACKGROUND/DISCUSSION

The Public Employees’ Retirement System (PERS) administers the retirement program for all contracting agencies in compliance with the Government Code.  Government Code Section 21221(h) allows an agency to request an extension of the 960 hour rule in a calendar year for the following reasons:  during an emergency to prevent stoppage of public business or because the retired employee has skills needed in performing work of limited duration.  An extension to allow for a recruitment process to be completed falls under this section of the Government Code.

EXISTING POLICY

This request is in compliance with PERS administrative rules and the State of California Government Code.

FISCAL IMPACT

There is no fiscal impact since there is salary savings from the vacant Director of Human Resources position.

Conclusion

There is a need to continue with an Interim Director for Human Resources until the end of July to allow for completion of projects and to provide direction for Human Resources staff and to assist other departments citywide.

RECOMMENDATION

Adopt a resolution of the City Council of the City of Sunnyvale requesting an extension of the maximum hours (960) of employment after retirement for the Interim Human Resources Director pursuant to Government Code Section 21221(h).
