Honorable Alden E. Danner

Presiding Judge

Santa Clara County Superior Court

191 North First Street

San Jose, CA  95113

Dear Judge Danner:

The Sunnyvale City Council received the Santa Clara County Civil Grand Jury’s Final Report on Tasers – Training and Tracking on May 16, 2006.  Following is the Council’s response to the Findings and Recommendations as required by Penal Code § 933.5(a) and § 933.5(b).

Finding 1

“Guidelines for taser training, usage and tracking are not coordinated among law enforcement agencies in Santa Clara County.”

          Response:  Agrees In Whole.

Recommendation 1a

“Law enforcement agencies in Santa Clara County should create a professional forum which meets on a regular basis to share and evaluate agency training and experience with tasers.”

Response:  The Council finds Recommendation 1a “Not Applicable,” because the Sunnyvale Department of Public Safety does not use the taser as a force option.  The Sunnyvale City Council has no jurisdiction over other law enforcement agencies.

Recommendation 1b

“Law enforcement agencies in Santa Clara County should establish defined protocols and guidelines for using tasers, including tracking any use of tasers.”

Response:  The Council finds Recommendation 1b “Not Applicable,” because the Sunnyvale Department of Public Safety does not use the taser a force option.  The Sunnyvale City Council has no jurisdiction over other law enforcement agencies.

On behalf of the Sunnyvale City Council, I thank you for the ongoing work and commitment of the Santa Clara County Civil Grand Jury.

Sincerely,

Dean J. Chu

Mayor
