SUBJECT: Acceptance of FY 2004/2005 Transportation Fund for Clean Air Grant Funds for In-Pavement Crosswalk Warning Lights and Budget Modification No. 27
REPORT IN BRIEF
The City has received grant funding for In-Pavement Crosswalk Warning Lights at three locations from the Bay Area Air Quality Management District (BAAQMD) Transportation Fund for Clean Air (TFCA).
The FY 2004/2005 project cost is $141,200. Based on a formula relating to the project’s cost effectiveness in reducing motor vehicle emissions, the BAAQMD has awarded the project $58,100. An additional $83,100 is required from the Gas Tax fund in order to accept the BAAQMD grant. This report recommends Council approve Budget Modification No. 27 to accept the TFCA grant in the amount of $58,100, appropriate this grant and $83,100 in Gas Tax monies to the In-Pavement Crosswalk Warning Lights project.
BACKGROUND
The TFCA provides grants to local governments for projects that will reduce air pollution. The BAAQMD, of which Council Member Miller is a member of the Board of Directors, administers the grant program in the San Francisco Bay Area.
The TFCA is funded by a surcharge of $4.00 on motor vehicle registration fees paid within its jurisdiction. The surcharge revenues are to be used to implement specified transportation control measures that are included in the BAAQMD’s Clean Air Plan, developed and adopted pursuant to the requirements of the 1988 California Clean Air Act.
TFCA provides grants to local governments for projects that will reduce air pollution. Sixty percent of the annually available funds are administered by the BAAQMD, while 40% are returned to Bay Area counties. The grants discussed in this report are from the 60% fund administered by the BAAQMD. The fund covers a wide range of project types, including purchase or lease of clean fuel buses; purchase of clean air vehicles; shuttle and feeder bus service to train stations; ridesharing programs to encourage carpool and transit use; bicycle facility improvements such as bike lanes, bicycle racks, and lockers; arterial management improvements to speed traffic flow on major arterials; smart growth; and transit information projects to enhance the availability of transit information.
On July 13, 2004 (RTC #04-253), Council authorized filing of three FY 2004/2005 TFCA grant proposals. At that time, Council also certified the availability of matching funds, and authorized the City Manager to execute the required TFCA agreements. At that time, staff noted that if the proposals were to be awarded for funding, staff would return to Council with a budget modification. At its May 20, 2004 meeting, the Bicycle and Pedestrian Advisory Committee (BPAC) recommended filing applications for the three proposals recommended by staff.
EXISTING POLICY
Air quality Sub-Element – Goal A: Improve Sunnyvale’s Air Quality and reduce the exposure of its citizens to air pollutants.
Land Use and Transportation Element R1.3.1 – Participate in intergovernmental activities related to regional and sub-regional land use and transportation planning in order to advance the City’s interests.
Land Use and Transportation Element C3.5.4 - Maximize the provision of bicycle and pedestrian facilities.
Fiscal Sub-Element 7.1B.4d – Pursue and use intergovernmental assistance for projects in the Ten-Year Capital Improvement Plan.
DISCUSSION
On December 21, 2004, the BAAQMD Board of Directors approved $58,100 in grant funding for the In-Pavement Crosswalk Warning Lights project. The project will construct in-pavement warning lights in crosswalks at three intersections; Tasman Drive/Fair Oaks Avenue, Remington Avenue/Mango Drive at Sunnyvale Middle School, and Murphy Avenue/Iowa Avenue. The locations were chosen based their adjacent land use, pedestrian activity, collision history, and type of intersection control. The enhanced crosswalks increase driver awareness of pedestrians waiting to cross the street and pedestrians already in the crosswalk. The project will promote walking and create a pedestrian friendly environment in Sunnyvale.
If Council chooses not to accept the grant award from the BAAQMD, the pedestrian project will not be completed at this time and no City funds would be allocated.
FISCAL IMPACT

An Office of Traffic Safety grant of $22,000 from FY2003/2004 will also be used as matching funds for this project making the total construction expenditure $163,200.
Future infrastructure replacement costs in the amount of $24,000 would be needed 12 years from the construction completion year. Replacement costs will be submitted for Council approval as an infrastructure replacement project in the FY 2005/06 budget.

ALTERNATIVES

2. Do not accept the Bay Area Air Quality Management District, Transportation Fund for Clean Air grant award.
RECOMMENDATION
Staff recommends Alternative 1: Approve Budget Modification No. 27 to accept the grant, appropriate the grant and appropriate $83,100 in Gas Tax monies as local agency matching funds to the In-Pavement Crosswalk Warning Lights project.
