RESOLUTION NO. ______
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SUNNYVALE AUTHORIZING THE CITY OF SUNNYVALE TO PARTICIPATE IN THE SAFE HAVEN PROGRAM FOR NEWBORNS
WHEREAS, the State Legislature has enacted Health and Safety Code section 1255.7 which allows any person having lawful custody of a minor child, 72 hours old or younger, to surrender physical custody of the child to an employee at a location designated by the Board of Supervisors;
WHEREAS, the City of Sunnyvale Department of Public Safety is desirous of having all six of its Fire Stations (Nos. 1 through 6) so designated;
WHEREAS, such designation is for the benefit of children and the community because it will provide a safe haven to newborns who are 72 hours old or younger;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SUNNYVALE HEREBY RESOLVES AS FOLLOWS:
Section 1. That all six Fire Stations (Nos. 1 through 6) of the City of Sunnyvale Department of Public Safety may be designated by Santa Clara County as locations which may accept newborns who are 72 hours old or younger from a person who has lawful custody of the minor child.
Section 2. The City Manager is authorized to request that the Board of Supervisors for Santa Clara County designate all six of the Department of Public Safety's Fire Stations (Nos. 1 through 6) in the City of Sunnyvale as locations which may accept newborns who are 72 hours old or younger from a person who has lawful custody of the minor child.
Section 3. The City Manager is authorized to execute any documents which are necessary to effectuate this designation and which are consistent with this Resolution.
