SUBJECT: Award of Bid #F0402-36 for the Construction of a Bicycle and Pedestrian Trail on Calabazas Creek
REPORT IN BRIEF
Approval is requested for the award of a contract to Jones Bros. Enterprises, Inc., of Morgan Hill for the construction of a bicycle and pedestrian trail on Calabazas Creek between US Highway 101 and Route 237 for the Department of Public Works Engineering Project Administration (Public Works Project No. TR-00/06-03).
BACKGROUND
The Calabazas Creek Trail project provides a bicycle and pedestrian trail on Calabazas Creek from US Highway 101 to Route 237 which connects to the John W. Christian Greenbelt at Fairwood Park. A portion of the trail crosses lands owned by the City of San Francisco and administered by the San Francisco Public Utilities Commission. Project funding is predominately Federal and Transportation Development Act grant funds supplemented by local matching funds.
The project includes construction of approximately one mile of asphalt concrete pathway and placement of a 125’ prefabricated steel bridge, including foundation and approach structures, over the creek bed.
DISCUSSION
Bid specifications were prepared by Public Works and Purchasing staff. The Notice Inviting Bids was published in The Sun on March 9, 2005. The bid package was distributed to Bay Area Builders Exchanges and broadcast to potential contractors through the DemandStar by Onvia public procurement network. Twenty eight contractors requested bid documents.
Sealed bids were publicly opened on March 30, 2005. Four responsive bids were received, as follows:

The Notice Inviting Bids section of the bid specifications listed the following mandatory bidder requirements:
“Bidders shall have completed within the past five years a minimum of three similar roadway, bridge trail related projects involving work with permit restrictions (similar to SCVWD and SFPUC), each project valued at no less than $2,000,000.”
An additional bid in the amount of $852,198 was received from ESR Construction, Inc. of San Jose, but the bid was deemed non-responsive because the bid included no roadway or bridge trail related references.
Staff recommends acceptance of the bid from Jones Bros. Enterprises, Inc., the lowest responsive and responsible bidder
A Negative Declaration was prepared and filed for this project pursuant to the provisions of CEQA.

Calabazas Creek Trail is funded in the FY 2004/05 budget from a variety of sources. The total budget of $800,430 is funded through a $309,726 grant from the Federal Transportation Equity Act for the 21st Century (TEA 21), $200,000 from a Santa Clara Valley Water District Trails Parks and Open Spaces grant, and $290,704 in Transportation Development Act funds (TDA). The current available balance is $794,375.
An additional $182,048 of 2005 TDA funds are needed to meet the cost of the current construction bid and to provide a sufficient contingency for the project. The FY 2005/2006 TDA funding request is addressed in a separate Report to Council which is also on the May 17, 2005, agenda.
RECOMMENDATION
It is recommended that Council:
1. Award a contract, in substantially the same form as the attached draft and in the amount of $855,390 to Jones Bros. Enterprises, Inc., for construction of the Calabazas Creek Trail Project, and
2. Approve a project contingency in the amount of $121,033.
