A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SUNNYVALE APPOINTING DAVID E. KAHN CITY ATTORNEY

          WHEREAS, Section 900 of the Charter of the City of Sunnyvale provides that the City Attorney shall be appointed by the City Council; and

          WHEREAS, it is the desire of the City Council to appoint a City Attorney and to provide certain benefits, establish certain conditions of service and to set working conditions;

          NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SUNNYVALE THAT:

          1.       It appoints David E. Kahn City Attorney of the City of Sunnyvale, effective May 23, 2005.

2.       The starting salary of the City Attorney shall be the sum of $178,000.00 per year, in accordance with the terms and conditions of the Agreement for Services between the City of Sunnyvale and David E. Kahn, attached hereto as Exhibit “1” and made a part hereof.

          3.       The City Attorney shall be entitled to retirement and other benefits in accordance with the terms and conditions of the Employment Agreement between City of Sunnyvale and David E. Kahn, City Attorney.

          BE IT FURTHER RESOLVED that the City Attorney shall also fill the position of General Counsel of the Redevelopment Agency of the City of Sunnyvale.
