A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF SUNNYVALE AUTHORIZING SUBMISSION OF THE PROPOSED AMENDED AND RESTATED REDEVELOPMENT PLAN FOR CENTRAL CORE REDEVELOPMENT PROJECT AREA, AND THE ACCOMPANYING REPORT TO CITY COUNCIL

WHEREAS, the Redevelopment Agency of the City of Sunnyvale (the "Agency") staff has prepared the Amended and Restated Redevelopment Plan for the Central Core Redevelopment Project Area (the “Amended Plan”) and a Report to City Council (the "Report"); and

WHEREAS, pursuant to California Community Redevelopment Law, the Agency desires that a public hearing on the Amended Plan be jointly convened by the Agency and the City Council of the City of Sunnyvale (the "City Council") on Tuesday, October 25, 2005, at 7:00 p.m.; and

WHEREAS, pursuant to California Health & Safety Code Sections 33346, 33347, 33385, 33385.5 and 33453, prior to the public hearing on the Amended Plan, the proposed Amended Plan must first be submitted to the City of Sunnyvale Planning Commission for its recommendation and report; and

WHEREAS, the Environmental Impact Report for the Sunnyvale Downtown Improvement Program Update 2003, certified by the City Council on June 17, 2003, and the Amended Plan conforms to the General Plan for the City of Sunnyvale; and

WHEREAS, the Amended Plan and Report must be formally submitted to the City Council for its review after submission of the Amended Plan to the Planning Commission and prior to the aforesaid public hearing.

          NOW, THEREFORE, BE IT RESOLVED BY THE REDEVELOPMENT AGENCY OF THE CITY OF SUNNYVALE THAT:

1.       The Executive Director of the Agency is hereby authorized to submit the Amended Plan to the Sunnyvale Planning Commission for its report, recommendation, and review as herein above stated, and the Planning Commission is hereby authorized to conduct such hearings and reviews as are appropriate.  The report and recommendation of the Planning Commission shall be due to the City Council prior to the October 25, 2005, joint public hearing on the Amended Plan.

2.       The Executive Director of the Agency is hereby authorized to submit the Amended Plan and the Report to the City Council for its review after submission to the Planning Commission and prior to the public hearing.
