On October 24, 2006 the Sunnyvale City Council approved a new combining Zoning District (Places of Assembly – POA) that allows consideration of specified Places of Assembly (e.g. places of worship, community centers) and Recreation uses. Properties with the POA designation (which may be combined only with the M-S Zoning District), still allow uses considered in the M-S Zone regulations. Places of Assembly uses within industrial areas can only be considered on M-S Zoned sites with the (POA) Combining District. Proposed Places of Assembly and Recreation uses will be evaluated on a case by case basis through the Use Permit process.

Q: If a property has been rezoned to Places of Assembly (POA), is the existing R&D, manufacturing, assembly, or office use be non-conforming?
A: No, the POA is combined with the underlying M-S zoning district and all uses permitted in the M-S zoning district are still allowed.
Q: Can a place of worship, community center or recreation use be established on a property that is not zoned POA?
A: No, these uses are only allowed on properties with the POA zoning designation.
Q: What is required for new places of assembly (such as places of worship, community centers, recreation uses, educational uses) looking to locate in a POA zoned site?
A: The POA regulations require these uses to obtain approval of a Use Permit. These permit applications are considered at a public hearing and require notification to property owners and tenants within 1000 feet.
