Project Approval

  Final Subsequent Environmental Impact Report - November 1, 2013 - November 11, 2013
The Final Subsequent Environmental Impact Report (FSEIR) has been completed and is available below. The purpose of the FSEIR is to provide written responses to those comments provided during the 45-day public review period. In addition, the FSEIR also contains clarifcations and refinesments to the Draft SEIR and the Mitigation Monitoring and Reporting Program (MMRP).

Jay Paul Company requested a Specific Plan Amendment to the Moffett Park Specific Plan (MPSP) on November 20, 2012. The request was to change several parcels within the MPSP from Moffett Park Industrial (MP-I) to Moffett Park Transit Oriented Development (MP-TOD). The project site is generally located between North Mathilda Ave and Borregas Avenue and Moffett Park Drive and E Java Drive. The requested change would increase the allowable Floor Area Ratio (FAR) for these parcels, allowing up to an 80% FAR with the Green Building Incentive. The City Council approved the initiation request to allow Jay Paul to submit a formal application to further study the requested change. Specific Plan Amendment

The project applicant has submitted the formal application for the proposed development and studies need for the environmental analysis. The proposed project includes the following:

The Moffett Place project is a proposed development of a 55.394 acre office complex in Sunnyvale, California. The proposed development would replace approximately 473,200 square feet of existing office space with six new eight-story office buildings, a two-story amenities building, surface parking and a three-level parking structure for a total of approximately 1.8 million square feet of total building area.  Within the campus layout would be two large landscaped common spaces to accommodate active and passive recreation on-site.

The proposed Moffett Place will require the following modifications to the existing 2004 Moffett Park Specific Plan:

  • Eight parcels currently planned as Moffett Park Industrial (MP-I) changed to Moffett Park Transit Oriented Development (MP-TOD).
  • Amend the specific plan to allow the base density of the existing MP-1 parcels to increase from a 35% up to approximately 50% Floor Area Ratio (FAR).

An increase in square footage of 20% FAR is allowed in the MP-TOD area resulting in a 70% FAR and an additional 10% is allowed through the City’s Green Building Program. The proposed square footage over the existing base FAR would be allocated from the Moffett Park Specific Plan Development Reserve and would not increase the overall density of Moffett Park.

The proposed project will require the following entitlements from the City of Sunnyvale:

  • Amendment to the MPSP to change project parcels from MP-I to MP-TOD and to amend language for siting MP-TOD parcels.
  • Rezoning of the project parcels from MP-I to MP-TOD
  • Moffett Park Major Design Review
  • Parcel Map
  • Potential Development Agreement

With the consideration of the Specific Plan Amendment and zoning changes, an Environmental Impact Report (EIR) will be prepared to analyze the associated environmental impacts. This process will involve the consideration of past environmental documents that have already been completed for the area including the 2003 Program Environmental Impact Report (EIR), and any additional environmental review for development applications within the Specific Plan area that have been approved since 2006.

Environmental Review

A 30-day Notice of Preparation (NOP) public review period began on February 13, 2013. This time is provided for the public or other agencies to provide comments regarding the environmental analysis. The City held a Scoping meeting on February 28, 2013 to solicit input from the public regarding the scope of Environmental Impact Report (EIR). The City of Sunnyvale incorporated relevant information into the Draft EIR, including results of public scoping and technical studies. The Draft EIR wwas circulated for public review and comment for the required 45-day public review period. All individuals that have requested, in writing, were placed on a Notice of Availability list for the Draft EIR. In addition, the Draft EIR and related materials were made available for review on this webpage, at the Sunnyvale Public Library (address above), and at the City of Sunnyvale, located at 456 W. Olive Avenue, Sunnyvale, CA 94086. Following receipt of all written comments on the Draft EIR, the City of Sunnyvale prepared Responses to Comments as part of the Final EIR, which were considered and acted upon by the City of Sunnyvale’s Planning Commission and City Council. The City of Sunnyvale provided notification of future public meetings for this project to individuals that have requested to be included on the project interest list.

March 25, 2013:
Planning Commission Study Session for Architecture & Site Design

February 13, 2013 to March 15, 2013: Notice of Preparation (NOP) 30-Day public review period (see discussion below).

February 28, 2013: EIR Scoping Meeting to gather input regarding the scope of the Environmental Impact Report (see discussion below). The project applicant team and approximatley five members of the public attended.

August 30, 2013 - October 15, 2013: 45-Day Review Period
A Draft Subsequent Environmental Impact Report (DSEIR) was prepared for Jay Paul Company’s Moffett Place project located in Moffett Park in the area between Borregas Drive and Mathilda Avenue. The project includes six eight-story buildings, two parking structures, an amenities building and an extension of Innovation Way to Bordeaux Drive. The developer is also negotiating a Development Agreement (DA) with the City (see the alternatives section of the DSEIR). Preliminary terms of the DA was reviewed with the City Council at a Study Session on September 24, 2013. The project requires a Moffett Park Specific Plan Amendment (GPA), Rezone (RZ), Major Moffett Park Design Review (MMPDR), and Environmental Review (SEIR). The EIR is available below and hardcopies are available at City Hall, the Library and Community Center for review.

The California Environmental Quality Act (CEQA) requires a minimum 45 day review of a draft EIR. The 45-day review period begins on August 30, 2013 and ended on October 15, 2013. The purpose of the 45-day review period is to provide comment on the adequacy of the DSEIR. A Planning Commission hearing was held on October 14, 2013 to take public testimony on the project. At the end of the 45 days, staff compiled all comments and work with the consultant to provide a response to comments. The response to comments and Final SEIR were brought forward for formal public hearings with the Planning Commission and City Council. The key dates are noted below.


  • September 9, 2013: Planning Commission Study Session on the SDEIR
  • September 24, 2013: City Council Study Session on the DA and overview of the project and SDEIR
  • October 14, 2013: Planning Commission Public Hearing to gather public comment on the DSEIR
  • October 15, 2013: 45-day Review Period ends
  • November 11, 20103: Planning Commission Public Hearing on the GPA, RZ, MMPDR, SDEIR and DA
  • December 3, 2013: City Council Public Hearing on the GPA, RZ, MMPDR, SDEIR and DA

Community Outreach

October 30, 2013 - Community Outreach Meeting
The project applicant hosted a community outreach meeting on October 30, 2013. The applicant provided information on the plans and photo simulations of the proposed project from several vantage points. The applicant and staff were available for questions. Following the outreach meeting, the project went to the Planning Commission on November 11, 2013 and City Council on December 3, 2013 for consideration.
