PARK USE PERMIT CONDITIONS
- Permit shall not become valid until all conditions stipulated herein are met. The applicant must provide a means of informing all participants of the terms and conditions of the use permit.
- Permittee is limited solely to the purposes, times and location as stipulated within the terms of this permit.
- A reservation is tentative until fees are paid and signed copy of permit is received. Reservation fees must be paid by due date shown on permit.
- To be eligible for refunds, you must contact the reservations office at least 30 days prior to your event.
- Minors are not eligible to reserve a facility. Groups composed predominantly of participants under the age of eighteen (18) must be chaperoned at a ratio of one adult to ten (10) minors.
- Please respect the sensitive natural habitat areas and do not bring pets into the park or feed the birds or other wildlife.
- Use of inflatables (Cosmo jumps, bounce houses, etc), heavy or extra large equipment, amplified sound or music, or specialty decorations is by permit only. Dunk Tanks are not allowed at this park. Because of the danger to wildlife, balloons, including water balloons, are not allowed. Please, no staples, tacks or nails in picnic tables.
- ALCOHOLIC BEVERAGES. Wine and beer only are allowed and within picnic areas only, as part of a meal.
Responsibility for general setup and cleanup of the premises shall be the responsibility of the permittee. Structures and grounds shall be left free of debris and other refuse pertaining to said use. Cleanup includes cleaning off table and grounds around tables, and placing all refuse in receptacles provided. Please recycle glass, plastic and metal products.
AGREEMENT TO HOLD HARMLESS
Permittee agrees to indemnify the City, its officers, agents and employees and hold them harmless from and against all loss, damage, expense and liability resulting from injury to or death of any person and loss of or damage to property or claims of such injury, death, loss or damage, and arising out of or connected with the use of the permitted facilities by permittee. In addition, permittee waives all claims or causes of action against the City, its officers, agents or employees for damage to or loss of property of any kind or for injury to persons occurring in or upon the permitted facilities arising from any cause other than the negligence or willful misconduct of the City, its officers, agents or employees and to which the permittee or his/her agent in no way contributed, either actively or passively, causing such damage, loss or injury.
AGREEMENT TO ABIDE BY RULES AND REGULATIONS
Permittee agrees to abide by rules, regulations, and conditions adopted by the City of Sunnyvale as set forth in the Municipal Code and all applicable State and Federal rules, ordinances, laws and regulations, and understands that permission for use of park facilities is contingent upon compliance with these rules, regulations and conditions.
