A public hearing will be held by the Administrative Hearing Officer at City Hall, 456 West Olive Avenue, Sunnyvale, CA for the purpose of considering the following applications:

    CALL TO ORDER   

    1.   2005-0130: Application for a Use Permit and multiple Variances on a 6,500 square foot site from Sunnyvale Municipal Code sections 19.34.030, 19.48.050, 19.40.060, to allow 0-foot side and rear yard setbacks, greater than 25% encroachment of the rear yard area, and over 800 square feet of accessory utility buildings.  The property is located at 583 Carroll Street (near Old San Francisco Rd) in an R-0 (Low-Density Residential) Zoning District.  (APN: 209-31-014) RK

   2.    2005-0131 – Susan Walker [Applicant] Boursalian Hrair and Araknaz Trustee [Owner]: Application for a Special Development Permit on a 1,875 square-foot site to allow the sale of wine and the operation of a new 464 square-foot wine-tasting room within an existing building.  The property is located at 165 South Murphy Avenue in a DSP-2 (Downtown Specific Plan/Subdistrict 2) Zoning District.  (APN: 209-06-011) AM

   3.    2005-0144 – Craig Colvin [Applicant] Dollinger Oakmead Associates, Lp [Owner]: Application for a Use Permit on a 1.7-acre site to allow a wood shop and instructional classes (woodworking).  The property is located at 452 Oakmead Parkway (near E Arques Ave) in an M-S (Industrial & Service) Zoning District.  (APN: 216-44-024) TZ

   4.     2005-0143: Application for a Variance from SMC (Sunnyvale Municipal Code) section 19.34.030 and 19.46.060 (4) to allow a one-story addition to an existing one-story house resulting in a four–bedroom house without 2 covered parking spaces and total side yard setback of 10 feet where 12 feet is required. The property is located at 267 Eureka Court (near San Diego Ave) in an R-0 (Low-Density Residential) Zoning District.  (APN: 204-24-043) KD

PLEASE TAKE NOTICE that if you file a lawsuit challenging any final decision on any public hearing item listed in this agenda, the issues in the lawsuit may be limited to the issues which were raised at the public hearing or presented in writing to the City at or before the public hearing.  PLEASE TAKE FURTHER NOTICE that Code of Civil Procedure section 1094.6 imposes a 90-day deadline for the filing of any lawsuit challenging final action on an agenda item which is subject to Code of Civil Procedure section 1094.5.
