SPECIAL MEETING
AUGUST 1, 1998

 

The City Council of the City of Sunnyvale met in a Special Meeting in the City Council Chambers, 456 W. Olive Avenue, Sunnyvale, California, at 9:00 a.m., with Mayor Jim Roberts presiding.

Mayor Roberts acknowledged Vice Mayor Manuel Valerio, teleconference call from Funchal (Capital City Island of Madeira) in Portugal. Mayor Roberts requested Vice Mayor Valerio indicate the password to verify he is Vice Mayor Valerio. Vice Mayor Valerio stated his mother’s maiden name "Rodrigues" as the password. The Deputy City Clerk verified that this was the password given to her.

Robert LaSala, the City Manager, introduced Jeffrey Sloan to present the staff report.

Jeffrey Sloan, Labor Attorney with Curiale, Dellaverson, Hirschfeld,Kelly & Kramer (San Francisco) noted that he represents public sector management.

The public hearing was declared open at 9:27 a.m.

Title of Resolution No. 146-98:

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SUNNYVALE CALLING A SPECIAL MUNICIPAL ELECTION TO BE HELD IN THE CITY OF SUNNYVALE ON NOVEMBER 3, 1998, FOR THE PURPOSE OF SUBMITTING TO THE VOTERS OF THE CITY TWO MEASURES CONCERNING BINDING ARBITRATION AND LABOR AGREEMENTS, REQUESTING ELECTION CONSOLIDATION AND THE SERVICES OF THE REGISTRAR OF VOTERS.

City of Sunnyvale Measure S:

Shall the Sunnyvale City Charter be amended to require voter approval of any labor agreement resulting from binding arbitration or fact finding before the agreement may become effective, if the provisions negatively affect management rights or require additional revenues or appropriations, or if either side wishes to seek voter approval?

City of Sunnyvale Measure T:

Shall the Sunnyvale City Charter be amended to provide that disputes about wages, hours and other terms, and conditions of employment that cannot be resolved by negotiations between the City and the Public Safety Officers Association and the Communications Officers Association be subject to binding arbitration which is final without City Council or voter approval?

ROBERTS moved to adopt a resolution placing a companion measure on the ballot, seconded by VORREITER and carried by the following roll call vote:

AYES: MILLER, ROBERTS, VALERIO, VORREITER, WALKER

NOES: FOWLER, KAWCZYNSKI

ABSENT: NONE

 

ADJOURNMENT

There being no further business the Mayor declared the meeting adjourned at
