City of Sunnyvale Planning Commission APPROVED |
A regular meeting of the Sunnyvale Planning Commission was held on July 8, 2002, at 8:00 p.m. in the Council Chambers, City Hall, 456 West Olive Avenue, Sunnyvale, with Chair Brown presiding.
Members Present: Vice Chair Simons; Comms. Chu, Lee, Satterlee and Swegles
Members Absent: Comms. Babcock and Moylan

PUBLIC HEARING:
Trudi Ryan, Planning Officer, welcomed Ron Swegles to the Planning Commission.
Approval of Minutes
Staff noted corrections on Item #2002-0297, page six. Comm. Chu asked to rephrase the paragraph for clarity and staff made corrections to state "he did not want to limit emergency accessibility."
Staff further noted that on page seven the vote should be stated 5-1 and not 5-0-1.
Vice Chair Simons asked staff to include the vote in the Summary Minutes.
Vice Chair Simons also commented that his friendly amendment was not accurately reflected and that his amendment was that the City Arborist was to recommend large species of trees as feasible for the different tree replacement. Staff will review the tape.

There was no quorum to make an action and deferred the action on the minutes of June 24, 2002 to the next public hearing. |
Report on Council Meeting
Trudi Ryan, Planning Officer, reported that on June 25, 2002, City Council considered the Workplan for Privacy Issues Between Residential and Non-residential Developments and Zoning Districts with the Planning Commission's recommendations. The City Council approved the workplan and directed staff to prepare a separate paper for a potential study issue on operational aspects to be considered in December.

Public Hearing
Comm. Lee asked for clarification on the procedures for the election of Chair and Vice Chair. Ms. Ryan provided the Commission techniques that have been used in the past. She pointed out that the Charter states that a chair must be voted at the first meeting in July; however, the charter does not require that a Vice Chair be selected.
Vice Chair Simons opened the floor for Chair nomination.

Comm. Lee nominated Vice Chair Simons to be Chair. Nomination accepted and carried 5-0 with Comms. Babcock and Moylan absent. |

Comm. Satterlee made a motion not to have a Vice chair. Motion died due to lack of second. |

The Commission asked for clarification of nominating a Vice Chair who is not present. Staff explained that it could be done, but that the Commission may want to check with the nominees.
Comm. Chu withdrew his nomination.

Comm. Chu made a motion to defer the election of Vice Chair to the next public hearing. Comm. Satterlee seconded. Motion carried 5-0 with Comms. Babcock and Moylan absent. |

Staff recommended deferring the selection of seats until the election of Vice Chair. The Commission accepted staff recommendation. |

Comm. Satterlee made a motion on Item #2002-0312 to adopt the Negative Declaration and approve the Special Development Permit and the Tentative Map with modification to add that the final paint color shall be subject to the review and approval of the Community Development Director. Comm. Swegles seconded. Motion carried 5-0 with Comms. Babcock and Moylan absent. |

Comm. Satterlee made a motion on Item #2002-0079 to recommend to City Council Alternative 1 with modifications: 1) that Basic Design Principle 5 to be softened to be less directive on landscaping being formal vs informal; 2) that Design Guidelines, Section 3.1C to be modified to indicate other alternatives; 3) that Design Guidelines, Section 3.4A to be modified to be less confusing; 4) that staff go through the City-wide Design Guidelines specific to single family designs and reference appropriately the policies in the Single Family Design Guidelines and modifications be made if and when necessary. Comm. Chu seconded. Motion carried 5-0 with Comms. Babcock and Moylan absent. |

Oral Communications
Chair Simons welcomed Ron Swegles to the Planning Commission.
Comm. Chu announced that the Chinese Historical and Cultural Project is presenting the 9th Summer Festival on Sunday, July 14, 2002 at Kelly Park in San Jose. The festival is free and it is to celebrate the Chinese Heritage in Santa Clara County and to commemorate the construction of a Chinese temple, which was destroyed in Chinatown and has been reconstructed at the historical museum.
