City of Sunnyvale Planning Commission APPROVED |
A regular meeting of the Sunnyvale Planning Commission was held on September 23, 2002, at 8:00 p.m. in the Council Chambers, City Hall, 456 West Olive Avenue, Sunnyvale, with Chair Simons presiding.

Report on Council Meeting
Ms. Ryan, Planning Officer, reported that at the beginning of the City Council meeting of September 17 a Downtown 3-d model was presented. She invited the public to view the model at City Hall near the One Stop Center.
Also, the same evening, the City Council considered the project on Mary and Washington Avenue. The Council approved the project in accordance with the Planning Commission recommendation modifying the General Plan, Rezone to R1.7/PD, 31 single-family homes and to subdivide the property.
Furthermore, City Council also considered the project on Bellomo Avenue and approved the project in accordance with the Planning Commission recommendation.
Planning Officers Report
Ms. Ryan reported that on September 18, the first Planning Commission Downtown Forum was held. She reported that all the Planning Commissioners were present and there were approximately 83 attendees including staff and the Commission. She appreciated the publics indulgence for the small meeting room. She announced that the next Planning Commission Downtown Forum will be held on Wednesday, September 25 at the Fair Oaks Park at 7-9 p.m.
Lastly, she reported that recruitment for planners will be closing on Monday.
Citizens To Be Heard
Tom Meyer, resident and Vice Chair of Bicycle and Pedestrian Advisory Committee, speaking as an individual, asked the Commission to support a study issue proposed by two council members on the creation of American Disability Act (ADA) Advisory Commission. He stated that there seems to be a general lack of knowledge on ADA requirements in the City. He also encouraged the Commission to consider a study requiring private areas in single family developments to meet ADA requirements. He stated that there is no Federal mandate or regulation to require single family developments including private sidewalks to meet ADA requirements.

Comm. Swegles made a motion on Item #2002-0593 to adopt the Negative Declaration and approve the Use Permit as conditioned. Comm. Chu seconded. Motion carried 6-1 with Chair Simons dissenting. |
2. 2002-0073 - City of Sunnyvale: Privacy Issues Between Residential and Non-residential Developments and Zoning Districts (Also to City Council on 10/08/02) DP

Comm. Satterlee made a motion on Item #2002-0073 to recommend Alternative #1- introduce an ordinance to amend the Municipal Code concerning wall height between residential & non-residential properties; location of exterior security cameras; landscape buffer plant material; exterior lighting poles and levels; noticing adjacent residential properties of non-residential project applications for additions or new construction and trash enclosure location as recommended by staff with the following modifications: 1) that staff consider Comm. Moylans suggestion to define "glare" in the code and 2) that staff craft language posted in the city's web site direction to the public on where to obtain information on public hearing notices and meetings. Comm. Moylan seconded. Motion carried unanimously 7-0. |

4.. 2002- 0071 - City of Sunnyvale: Comprehensive Review of Below Market Rate Housing Program CC (Also to Housing and Human Services Commission on 09/25 and also to City Council on 10/08/02)

Vice Chair Babcock made a motion on Item # 2002-0071 to recommend Alternative #3 with modifications: 1) to increase the required percentage of BMR units to 12.5%; 2) to lower the number of parcels or units that are exempt to less than 10; 3) to keep the in-lieu fee provisions; 4) to add condominium conversions to the types of residential development required to dedicate units; 5) to extend the deed restrictions for purchase units to 55 years; 6) to extend the deed restriction for rental units "in perpetuity"; 7) to list eligibility priority category for program participants based on specific profession critical to the community infrastructure and not by certain employer; 8) to lower the income limits that qualify for rental units to 70% of median income or less and for purchase units 70% to 120%; 9) to continue to study the practicality of including single-family residential zoning districts in the BMR program; 10) to continue to study the modification of residential development standards to better enable density by providing incentives for higher density currently offered in the BMR program; 11) to institute an indexing method to annually adjust the sales price of new units and resale units; 12) to revise rent increase method to the lesser of 5% or the percentage increase in market rent in Sunnyvale and 13) to base sale price of units on income levels. Comm. Lee seconded. Motion carried 4-3 with Comms. Moylan, Satterlee and Swegles dissenting. |
5. Review of the Code of Ethics
Comm. Satterlee asked clarification about the Code of Ethics and the Brown Act relative to conversations outside the Chambers relative to actions taken by the Commission in the election of chair and vice chair.
Comm. Satterlee read Item #15 of the Code of Ethics - Independence of Boards and Commissions pursuant to earlier conversations of the Commission. "Because of the value of independent advice of the Boards and Commissions to the public decision making process, members of Council shall refrain from using their position to unduly influence the deliberations or outcomes of boards and commissions proceedings." She added that while appointed by City Council, the Boards and Commissions are independent bodies and can act independently.
Oral Communications
Comm. Satterlee would like to add an agenda item in the Study Session around the Brown Act on the election of Chair and Vice Chair.
Comm. Swegles would like staff to conduct a survey and a report stating that in the affordability housing, mobile home parks are included in the housing stock.
Comm. Chu announced that on Wednesday, September 25, a Planning Commission Downtown Forum will be held at the Fair Oaks Park from 7-9 p.m. to discuss the downtown urban design plan. The public is welcome.
Comm. Lee announced that Chair Simons, Comms. Chu and Satterlee attended the Silicon Valley Projections 2002 seminar. The program is very informative.
Chair Simons was glad to see many Commissioners at the Projections 2002 seminar and that there were approximately 10% of the attendees were Sunnyvale Leadership students, alumni and staff.
