SUMMARY

A regular meeting of the Sunnyvale Planning Commission was held on July 28, 2003, at 8:00 p.m. in the Council Chambers, City Hall, 456 West Olive Avenue, Sunnyvale, with Chair Babcock presiding.

Members Present: Chair Babcock; Vice Chair Moylan; Comms. Chu; Hungerford; Lee; Simons and Swegles

PUBLIC HEARING:

Approval of Minutes

Comm. Swegles made a motion to approve the minutes of July 14, 2003 with modifications. Comm. Chu seconded.

Motion carried 6-0 with Comm. Lee absent.

Report on Council Meeting

Gerri Caruso, Principal Planner, reported that on August 12, the City Council will consider two General Plan Amendment Studies - the Town Center and site located at 707 & 711 South Mathilda Avenue.

Planning Officer’s Report

Ms. Caruso reported that Trudi Ryan, Planning Officer, is on vacation. She and Fred Bell, Principal Planner, are available for the Commission during Ms. Ryan's absence.

Ms. Caruso reminded the Commission of the Boards & Commissions reception and orientation for new members to be held on Thursday, July 31. The reception will start at 5:30pm and the orientation at 6:00pm at the Council Chambers. She encouraged the Commission to attend and welcome the new members.

Furthermore, Ms. Caruso informed the Commission on August 11, 2003 meeting, the first half of the Study Session will start at 6:00PM at the Council Chambers and will be televised. Thereafter, the Commission will take a recess and reconvene at the West Conference Room for the second half of the session.

Public Hearing

  1. 2003-0103 - Application for a Special Development Permit on a 4,283 square foot site to allow a second story addition to an existing two-story home for a total of 2,679 square feet resulting in a 62% FAR (Floor Area Ratio) where 45% FAR is allowed without Planning Commission review. The property is located at 536 Cashmere Court in an R-2/PD (Low-Medium Density Residential/Planned Development) Zoning District. (APN: 323-12-015) KD (Application Withdrawn)
  2. ACTION: Gerri Caruso, Principal Planner, reported that the applicant withdrew the application. There is no action required of the Planning Commission.

    APPEAL OPTION: Not appealable, no action made.

  3. 2003-0457 - Ron Richardson [Applicant] California Water Services [Owner] - Application for a Use Permit on a 33,000 square foot site to allow an emergency storage yard at an existing tank/well site. The property is located at 623 West Fremont Avenue in an R-1 (Low Density Residential) Zoning District (APN: 202-06-001)(Negative Declaration) ) (Applicant requests continuance to August 11, 2003) GC
  4. ACTION: Vice Chair Moylan made a motion on Item #2003-0457 to approve the continuance to August 11, 2003. Comm. Chu seconded. Motion carried 6-0 with Comm. Lee absent.

    APPEAL OPTION: Not appealable at this time, continued to August 11, 2003 Planning Commission meeting.

  5. 2003-0483 - City of Sunnyvale - Consideration to amend the existing Municipal Codes §19.32.020 and §19.26.200 (f)(3) to allow up to 45% lot coverage where 40% is currently allowed. (Negative Declaration) SL (Also to City Council on 08/12/03)
  6. ACTION: Comm. Chu made a motion on Item #2003-0483 to recommend Alternative #2, to introduce an Ordinance to amend Municipal Codes 19.32.020 and 19.26.200 (f)(3) with modifications that - 1) to increase lot coverage to 45% for single story homes on R-0, R-1 and R-2 Zoning Districts, where 40% is allowed; 2) to subject the two-story homes to the 40% lot coverage requirement and 3) to allow that for second story addition where first story is already at 45% lot coverage, a 5% would be required to be removed. Comm. Swegles seconded. Motion carried 5-1 with Vice Chair Moylan dissenting and Comm. Lee absent.

    APPEAL OPTION: Not appealable, item will be considered by City Council on August 12, 2003.

  7. 2003-0219 - Consideration of the Transportation Strategic Program Impact Fee (Also to City Council on August 26, 2003)
  8. ACTION: Comm. Simons made a motion on Item #2003-0219 to recommend Alternative #2 and 4 with modifications - 1) that retail at Moffett Park shall be assessed the same with the rest of the city retail; 2) that transportation impact fees for single family and multi-family be assessed per square feet; 3) to establish a two-tier retail establishment for impact fee assessment; 4) to provide an incentive for buildings located approximately 1200 feet from a multi-modal transit, and 5) that the fees for north of 237 shall not exceed double the amount from the fees imposed to south of 237. Comm. Swegles seconded. Motion carried 6-0 with Comm. Lee absent.

    APPEAL OPTION: Not appealable, item will be considered by City Council.

Oral Communications

Comm. Swegles announced that the Sunnyvale Chamber of Commerce is inviting the public for a fun night at the San Jose Giant Ball Game. 

Comm. Swegles also announced that his son arrived from Baghdad and is getting ready to leave for another tour of duty to England.

Further, he proudly announced that his father is who is 80 years old just received his high school diploma.
