A regular meeting of the Sunnyvale Planning Commission was held on August 11, 2003, at 8:00 p.m. in the Council Chambers, City Hall, 456 West Olive Avenue, Sunnyvale, with Chair Babcock presiding.

1. 2003-0457 - Ron Richardson [Applicant] California Water Services [Owner] - Application for a Use Permit on a 33,000 square foot site to allow an emergency storage yard at an existing tank/well site. The property is located at 623 West Fremont Avenue in an R-1 (Low-Density Residential) Zoning District. (APN: 202-06-001) (Negative Declaration) (Continued from July 28, 2003)
   

Comm. Simons made a motion on Item #2003-0457 to adopt the Negative Declaration and approve the Use Permit with modifications - 1) to remove Condition of Approval #3, 2)to add a condition that dumping shall be conducted in the morning unless another emergency occurs the same night and 3) to replace equipment with lowest noise models. Comm. Swegles seconded. Motion carried 5-2 with Vice Chair Moylan and Comm. Hungerford dissenting.

APPEAL OPTION: Appealable to City Council no later than August 26, 2003.

2. 2003-0491 - Moshe Mendelson and David Mark [Applicants/Owners] - Application for related proposals on a 15,561 square foot site located at 953 South Wolfe Road in an R-3 (Medium Density Residential) Zoning District. (APN: 211-50-001) (Mitigated Negative Declaration) FB (Also to City Council on August 26, 2003)

• Rezone from R-3 (Medium Density Residential) Zoning District to R-3/PD (Medium Density Residential/Planned Development) Zoning District;
• Special Development Permit to allow construction of seven townhomes; and
• Tentative Map to subdivide one lot into seven lots and one common lot.

ACTION: Vice Chair Moylan made a motion on Item #2003-0491 to adopt the Mitigated Negative Declaration, recommend approval of the Rezone, Special Development Permit and Tentative Map with modifications that large scale tress shall be included in the landscaping. Comm. Chu seconded. Motion carried 7-0.

APPEAL OPTION: Not appealable, item to be considered by City Council.
