SUMMARY

A regular meeting of the Sunnyvale Planning Commission was held on September 8, 2003, at 8:00 p.m. in the Council Chambers, City Hall, 456 West Olive Avenue, Sunnyvale, with Chair Babcock presiding.

PUBLIC HEARING:

Approval of Minutes

Comm. Lee made a motion to approve the minutes of August 25, 2003. Comm. Swegles seconded.

Motion carried 5-0 with Vice Chair Moylan and Comm. Hungerford absent.

Report on Council Meeting

Trudi Ryan, Planning Officer, reported that at the August 26th City Council Study session, the proposed Town Center site and architecture plans were reviewed. She noted that the council had similar comments to Planning Commission and staff.

Ms. Ryan further reported that at the public hearing that night, the Council considered a project located at 953 S. Wolfe Road. The Council concurred with the Planning Commission recommendation and approved the Rezone, Special Development and Tentative Map. She noted that during the discussion, there was confusion about the Below Market Rate (BMR) requirements and staff was directed to give a summary of the ordinance as approved by City Council.

Comm. Simons asked Ms. Ryan to comment on the potential alignment of Taaffe Avenue for the Town Center Mall site application. Ms. Ryan responded that the applicant explored the possibility of restoring Taaffe to its historic location; however, it was concluded that it was not feasible. However, the applicant proposed to bend the north side of Taaffe to match Taaffe Avenue, north of Washington, creating a connection but not a straight line.

Public Hearing

1. 2003-0474 - Appeal of a decision by the Director of Community Development denying a Tree Removal Permit for the removal of one large Deodar Cedar tree in the front yard. The property is located at 701 San Tomas Street in an R-0 (Low-Density Residential) Zoning District. (APN: 205-09-022) SL

Comm. Lee made a motion on Item Number 2003-0474 to grant the appeal and approve the removal of one large Deodar Cedar tree with an additional condition that the replacement tree shall be a large scale specie. Motion carried 5-0 with Vice Chair Moylan and Comm. Hungerford absent.

APPEAL OPTIONS: Not appealable, Planning Commission decision is final.

 

2. 2003-0591 - Corinne Barkow [Appellant] Tosh and Teresa Kameda [Owner] - Appeal of a decision by the Director of Community Development approving a Miscellaneous Plan Permit for a 6-foot high fence in the reducible front yard. The property is located at 1067 Lois Avenue in an R-0 (Low-Density Residential) Zoning District. (APN: 198-36-001) SL

Comm. Simons made a motion on Item Number 2003-0591 to deny the appeal and uphold the decision of the Director of Community Development approving the Miscellaneous Plan Permit for a 6-foot high fence in the reducible front yard. Comm. Swegles seconded. Motion carried 4-1 with Comm. Lee dissenting and Vice Chair Moylan and Comm. Hungerford absent.

APPEAL OPTIONS: Not appealable, Planning Commission decision is final.
